Buy.com class action info?

Hey folks,

I assume at least some of you are part of that Hitachi buy.com class action lawsuit from way back. Anyway, I was wondering if they had ever come to some sort of resolution? I know that the judge ruled but I never saw any money, did you?

Just wondering...

A couple of years ago, they made a typo on the price of a monitor. We all knew it was a mistake. Lots of people ordered it; few got one.

Many of those who didn't get one sued because they thought that they deserved the monitor, that they earned it at a ridiculously low price, simply because they took the two minutes to click the &quot;buy&quot; button.

I remember I tried something like this a while ago out of a catalog. They had a then-new TNT2 advertised for like $40. It was a mistake, but I found a disclaimer in the beginning of the catalog stating that typos and screwup prices wouldn't be honored. Couldn't buy.com have done something similar or is it different for online stores?

I just checked my settlement info Email I got a while back. Here's what I got as far as status...

&quot;A final settlement approval hearing will be held on December 1,
2000 at the hour of 1:30 p.m., in Department C-67 of the Orange County
Superior Court located at 909 N. Main Street, Santa Ana, California 92702,
before the Hon. Robert Thomas. At that time, the court will consider
evidence and argument regarding the fairness, adequacy and
reasonableness of the settlement so the court can determine whether to grant it
final approval; and the amount of any award of attorneys' fees and costs to
plaintiffs' counsel. Class members are entitled, but not required to
attend. Any member of the class who is satisfied with the proposed
settlement need not appear at the hearing to recover settlement proceeds.&quot;


The way the legal system drags things out who knows what the current status is. I'm not going to go into the whole ethics/morals thing because it just gets too ugly. Those who were involved know what I'm talking about... ;)

Thank goodness, someone else started this thread - I wasn't about to start one ... only to be flamed for bringing up the Wounded Monitor Child fiasco from two years ago -- yes folks, the two year anniversary is here and now.

Putting the B.S. aside, I had a transaction (via E-mail) with one of the lawyers who was involved with the case. Here goes:

My E-mail message that I sent on 1/18/2001:

Mr. Marlin, Esq.,

Assuming that I read through the Buy.Com settlement correctly, a decision was made that held Buy.Com liable for a pricing error that occurred nearly two years ago.

I was a purchaser of two of the items.

Could you direct me to someone in your firm that could provide me with more details about the settlement, such as when a pay out will be made and the amount of the pay out.

Here is the response that I received from Lou Marlin on 1/19/2001:

Payment will be made shortly after February 15. The amount to be paid to
each class member remains unknown.

The lawsuit was a joke, and the eithics of the people filing the claim make me want to gag.

Listen up kids, class action suits only benefit lawyers as had already been said. The final amounts to the disenchantised are paltry and the &quot;show me da money&quot; forms are intentionally difficult to understand and fill-out thus ensuring few claimants actually mail them. The lawyers are always well-paid and get most of the loot.

To those who joined this nonsense: you're pathetic. Where has reason gone?

And whatever happened to &quot;not responsible for typographical errors?&quot; :p

Actually, it's likely that nobody here joined the class action. It was an &quot;opt out&quot; suit, so unless you specifically told them to remove you, you're automatically included if you had ordered. No paperwork or forms.

The whole thing was started by some slimy lawyer in California.
