The article is full of misleading statements, nothing more. The EPA has never been extremely vigilant in sampling the millions of miles of waterways that we have, simply as a matter of practicality. Instead, the entire system is basically an honor system unless you get caught by a random test. For example, public wastewater treatment plant superintendents, who conduct their own water quality testing on-site in most cases, are not held liable if their plant violates its permit unless they don't report the violation and the EPA happens to be testing at the exact same time. However, the fines are large enough and the general ethical nature of people with no motivation to screw up the environment has lead to much, much cleaner waters as a result of the CWA.
