Bush can't have Texas Electoral Votes?

That is a shame.

Of all the characters in this ridiculous drama, he is the one I have had the most respect for.

What's next? 😛

<< The lawsuit cites the 12th Amendment to the Constitution, which says that if the president and vice president live in the same state, they can't win that state's electoral votes. >>

<< Cheney and his wife, Lynne, have owned a home in Highland Park, an upscale city in Dallas, since 1995 and claimed that as their legal residence for a discount on property taxes in the current year, Dallas tax records show. >>

How does this not violate the Constitution if Bush is allowed to count the 32 Texas Electoral votes?

<< The Electors shall meet in their respective states and vote by ballot for President and Vice-President, one of whom, at least, shall not be an inhabitant of the same state with themselves; they shall name in their ballots the person voted for as President, and in distinct ballots the person voted for as Vice-President, and they shall make distinct lists of all persons voted for as President, and of all persons voted for as Vice-President, and of the number of votes for each, which lists they shall sign and certify, and transmit sealed to the seat of the government of the United States, directed to the President of the Senate;--The President of the Senate shall, in the presence of the Senate and House of Representatives, open all the certificates and the votes shall then be counted;--the person having the greatest number of votes for President, shall be the President, if such number be a majority of the whole number of Electors appointed; and if no person have such majority, then from the persons having the highest numbers not exceeding three on the list of those voted for as President, the House of Representatives shall choose immediately, by ballot, the President. But in choosing the President, the votes shall be taken by states, the representation from each state having one vote; a quorum for this purpose shall consist of a member or members from two-thirds of the states, and a majority of all the states shall be necessary to a choice. And if the House of Representatives shall not choose a President whenever the right of choice shall devolve upon them, before the fourth day of March next following, then the Vice-President shall act as President, as in the case of the death or other constitutional disability of the President.--The person having the greatest number of votes as Vice-President, shall be the Vice-President, if such number be a majority of the whole number of Electors appointed, and if no person have a majority, then from the two highest numbers on the list, the Senate shall choose the Vice-President; a quorum for the purpose shall consist of two-thirds of the whole number of Senators, and a majority of the whole number shall be necessary to a choice. But no person constitutionally ineligible to the office of President shall be eligible to that of Vice-President of the United States.

This amendment, ratified in 1804, supersedes Article II, Section 1, paragraph 3, prescribing the operation of the Electoral College. Of particular interest is the spelling out of the process to be used in the event that no candidate receives a majority of the electoral votes.

Don't shoot the messenger! 😛

Russ conveniently left out the fact that it was thrown out in Florida not on its merits, but because it was considered the wrong venue.

I don't think this case will go anywhere, but I think it shines a spotlight on how Jr and his Veep-wanna-be, the self-proclaimed ethical standard bearers, played fast and loose with the residency rules.

The typical guilty until proven innocent approach so often seen from the left.

It is nice that Gore's Goobers have yet another little straw to grasp. Sad, though, that it's a short one.

Geez, give me a break -- what other crap are they going to try now? Voodoo?

I notice in that quote above, that it doesn't mention the timeframe for the residency requirement, which implies that it is at the time of the election by the college, which is Dec. 18. Further, who the fsck cares? This is about the equivalent of a law that says both the President and the Vice-President can't have blue eyes.

Interesting....so just where IS Cheney a resident?

Lived in Texas, but moved a few months before the election...

Interesting...

I hate to say this, but I wonder if this hasn't contributed to his ill health.

Like I said before, it is unfortunate and I like the man in general. However, I guess every stone must be unturned. If it were Lieberman, all h-e-double hockey sticks would be breaking loose!

edit: I am just making an observation. 😛

We have some stupid laws, what does this have to do with anything. I mean who cares if Bush and cheney reside in the same state. Is there really a major problem with that ?

I'm sure this will be laughed out of court.

Given #12 is all about electors, I'd say Andrew is correct: the VP can't be an "inhabitant" of the same state as the P on Dec. 18th. Looks like it's much to do about nothing, especially considering the amendment was written in 1803/04 and the intent of that portion was likely to prevent a dictatorship rising from a single powerful state.

According to "Official" paperwork, Dick Cheney's residence is in WY. He apparently saw this possibility in advance and moved his residence status there the day after being named as V.P. candidate. If this is all correct, it would be well in advance of of the Federal Mandate.

<< Of course, it's okay for Hillary to carpetbag her ass in to New York, though. >>

It AMAZES me Hilary won. I'd have a hard time supporting a non-New Yorker.
