Well she was going to get fired regardless (remember, they were going to call but found out she'd already been canned). If nothing else than because she did it in the presence of kids. If she behaves in such a way in front of middle-schoolers, who's to say she doesn't do such things in front of elementary-schoolers when she gets cut-off. Her boasting about in the office only serves her as an admission of guilt, and I'm willing to bet that such misconduct IS outlined in back-and-white in her employee handbook. If the fool had kept her mouth shut, then she might have been better off, but now she's screwed...as she should be, imo.

If the penalty for a first-time offence for such an action is designated directly or indirectly as a cause for firing, then she'd lose.

If she'd done this as a habit in other cases, then I'd say that she was acting in a manner which made this event just a matter of time. But nobody here has any indication of habit, so that's another issue.

But I doubt that this punishment would be the norm for a first-time offence. If she'd done this to random driver on the road would she have been fired?

Patriotic, my ass, that's just inappropriate conduct on the job. Your freedom of speech is not infringed by getting fired for obscene gestures or words while you're driving a school bus (or on any job, for that matter.)

It was inappropriate for her to do it in front of her students. Fired? A bit harsh. Everyone makes dumb mistakes, and I guarantee you the kids aren't shocked by a middle finger in this day and age. A good suspension would have made the point.
