Yes, Kimmel (and HuffPost) are correctly referencing yet another statute that Trump clearly violated, although this one actually has some teeth to it. Note the disqualification for any office under the United States is a "shall" penalty, not a discretionary penalty.

There are two considerations to make in regard to that...
  1. Having the appropriate clearance level is only part of the equation for having access to sensitive material. You also need to validated need-to-know.
  2. One requirement for continued access to sensitive material is proper handling and avoiding any leakage. An obvious issue is having sensitive material openly displayed in an unsecured area, and even if you talk about it being in a box (i.e. technically not openly displayed), it's still not properly secured for transport and definitely not for storage.

Normally, people would at the minimum lose their clearance for repeated occurrances of mishandling classified information. Which ultimately means, you loose your job. It absolutely torques the shit out of me, having worked in a classified environment for over 39 years of my career. You forget to lock the classified safe at night is a BFD!
