Bought Game on Ebay - CD Key is in Use - Out of Luck?

My son bought Tribes 2 on Ebay from someone who tried, but did not like the game. Unfortunately the original owner created an account and my son cannot reuse the game's key code. I've emailed the seller and asked if he would edit his log-on and password to something generic so my son could use the account. I haven't heard back. The Sierra site offers the following solution:

Problem:
The CD key is in use.

Solution:
Send us a clearly legible photocopy or scan of the jewel case that has the CD-KEY, along with a copy of the sales receipt. If you don't have access to a scanner, please type your CD key and any information identifying the account and send to:
tribes2account@sierra.com

I'm assuming since this is an Ebay sale, I'm out of luck. Told my son I'd ask the experts (you guys) if he had any options before he adds the game to his coaster collection.

No I don't think you should be out ot luck. You should definitely try contacting them with the info you have. Once you purchase something, from retailer or not, they give up their rights to the product. Well, I'm no lawyer, but that's how it should be.
 
Try contacting Sierra with a scan of the jewel case, explaining that you bought the game off EBay. Maybe they'll be able to do something.

Give the seller a week or two to respond. If he doesn't, write a bad review.
 
Yeah I agree....if Sierra care about customer service and want you to buy their products in the future I am sure they will help providing you can show them evidence of purchase.

Thanks for your suggestions. The seller answered my email, but he couldn't remember his logon info. I sent an email to Sierra with a scan of jewel case and link to the auction. Within 10 minutues the key was reset.
