Bought a Dirtbike yesterday for 1,200 (Suzuki KM250)

My buddy was cleaning the carb for me and he said he couldn't find it under the '98 repair manual and it showed up as a '96 model carb. I did the vin check on the bike and sure enough, a '96 Suzuki KM250.

Now, I realize I should have checked the vin before hand (even the title says '98), but I didn't realize someone would try to pull this. I got a good deal even as a '96 model (it is in pretty good shape), but I'm a little irked that it was mis represented.

What would ATOT do?

FYI, I bought it from a 19 year old kid (who may be a punk as it turns out). I'm thinking about calling him up and threatening legal action unless he gives me 100 or 200 bucks back.

What do you think?

Is it worth the hassle? He bought the bike a year ago and likely the guy who sold it to him swindled him originally.

He probably didn't even know what year it was. In my opinion you bought the bike based on looks and performance not whether it was 11 or 9 years old. I wouldn't even worry about it, especially on a dirt bike.

I'm leaning toward that line of thought too. The kid was pretty nice, he even drove the bike in his truck to my house and stuff (I didn't even ask, he just offered, I had planned on getting a truck from a friend's house).

These things don't come with a title? (I really don't know.)

If it bothers you enough, you can ask for $100 or $200 back and see what he says. If I was him, though, I'd probably just ask you if you want your money back and you could forget the deal ever happened... unless you were a dick to me, and then I'd tell you to piss off.

If the title says it's a '98, you have little room to stand on, he could just claim that he thought it was a '98 like it said on the title. Like you said, you got a good deal, lesson learned, don't be a punk about it.

Well that's pretty odd. I'm guessing these things are tracked by the DMV using the VIN. I'd imagine getting the year changed would be pretty challenging...

Do you care enough to report it to the DMV?

Forget it, remember it as a lesson for the future. The kid you bought it from probably doesn't have even half the sense you think he might.

If there was a contract that states you bought the bike 'as is' you don't have a legal leg to stand on.

Yeah, I thought it odd myself too. I don't care enough to call the DMV. I will probably just call him up and let him know what I found out. If he wants to do something about it, cool, if not, I won't pressure him.

Unless there are some huge differences between the two models I wouldn't do anything. Then again, I really don't know much about dirt bikes.

I would not call the kid. Why would you do that? He's notgoing to believe you, and will later think you were trying to rip him off. You got a bike that is legally titled as a 98, take it as it is.

Let it go. If you really give a crap then I guess you could demand that he refund your money and take the bike back but if it's in good shape and is otherwise what you want then you might as well keep it.
