DETROIT (WXYZ) - Former Grosse Pointe businessman and Rotary Club president Bob Bashara is now facing murder charges in the death of his wife Jane.

Wayne County Prosecutor Kym Worthy, flanked by other law enforcement officials, made the announcement at a news conference Wednesday.

Bashara was charged with first degree murder, conspiracy to commit first degree murder, solicitation to commit murder, suborning of perjury during a capital trial, witness intimidation and Obstruction of justice.

It was one year and three months ago that Jane Bashara’s body was found inside her SUV in an alley on Detroit's east side.

So what’s taken so long?

Worthy says it’s a complicated case that stretched across several states and included three hundred witnesses and five thousand documents.

"We are living in a TV kind of era when you thing everything is wrapped up in 44 minutes. And that's just not the way it happens," Worthy said.

The prosecutor also revealed that Bashara himself delayed their investigation and that resulted in some of the charges.

"We are alleging that he encouraged witnesses to call in false tips. We are alleging that he tried to get a witness or witnesses to leave the state so they could not be talked to. And we are alleging that he was, again, encouraging witnesses to lie to us during the pendency of this investigation," Worthy told reporters.

A source close to the case tells the 7 Action News Investigators Bashara's former mistress, Rachael Gillett was the witness he allegedly pressured to move out of state and the witness intimidation charge involves her and handyman Joe Gentz.

Gentz admitted to killing Jane Bashara under Bob Bashara’s direction and is serving seventeen to twenty eight years in prison, with an agreement to testify against Bashara.

Some legal observers say Gentz credibility will be a problem because he has a low I-Q and gave different accounts of what happened to police.

Worthy says she doesn't consider Gentz a star witness.

"He's a strong witness for us. He's a credible witness we think for us but certainly all of the witnesses in the case make up the case together," said Worthy.

Worthy refuses to talk about any details of their case and the court file has been sealed making it off limits to reporters.

Bashara is expected to be brought to Detroit next week for arraignment. Bob Bashara is currently serving a prison sentence for trying to hire a hit man to kill Gentz.

Prosecutor: Desire for kinky sex led Bashara to have wife killed

George Hunter
The Detroit News

Detroit— Prosecutors said Monday they plan to introduce evidence showing Bob Bashara’s penchant for kinky sex was a motive for murdering his wife, and that he contacted several people about having her killed before settling on his handyman, Joseph Gentz.

New details of the case against Bob Bashara emerged in a Detroit courtroom Monday as prosecutors laid out the time line of hundreds of phone calls that took place on the Grosse Pointe Park businessman’s phone — before and after his wife’s death — and gave what they called part of Bashara’s motive.

Wayne County Assistant Prosecutor Lisa Lindsey said Bashara sought people to do physical violence to a human being for money in the months leading up to Jane Bashara’s death, including a person he knew from his lifestyle in BDSM (bondage, discipline, sadomasochism).

Bashara’s attorney quickly objected to the mention of BDSM and questioned its relevance.

“We’ve taken such strong measures to make absolutely sure that everything was sealed” defense attorney René Cooper said. “And then within three sentences, we’re hearing about the BDSM lifestyle.”

There will be upcoming testimony and discussion about that lifestyle, Lindsey countered.

“The BDSM lifestyle is going to be a part of his motive for committing this crime,” she said.

Lindsey cited several witnesses who said they had conversations with Bashara about violence prior to his wife’s death.

One friend, identified as witness No. 63, was asked by Bashara if he knew anyone who would “rough somebody up” for money, saying he needed it done to a tenant, prosecutors said.

Another conversation with witness No. 151 dealt with Bashara asking to have a woman “T-boned or run over by a car,” Lindsey said during the pre-examination hearing that took place before 36th District Judge Kenneth King.

In addition, a text message sent by Joseph Gentz more than a month before Jane Bashara’s death showed Gentz’s state of mind before the killing, prosecutors said.

“When you get up, I really need to talk about something. If I know something about someone about to do someone in, where do I go?” the text message read. “I have to watch my (expletive). Please call me hon, I do not want to die.”

Bashara will be transferred to the Wayne County Jail as attorneys prepare for his preliminary examination scheduled for Sept. 9, Cooper said after the hearing.

Rene Cooper

Lawyer faces exposure charges
www.freep.com, 11 Nov 2005

Rene Cooper, 51, who works for the Legal Aid and Defender Association of Detroit, was charged by Wayne County prosecutors with three counts of indecent exposure after the women, ages 19, 22 and 27, flagged down an officer.

They said Cooper pulled down his pants and exposed himself around 6 p.m. Oct. 31 before running down the street with his pants down, according to a police report. He was arrested a short time later.

Cooper did not return phone calls Thursday.
...

According to court records, Cooper has three previous indecent-exposure arrests. In one case, he was acquitted, and another was dismissed.

In 1995, he pleaded no contest to indecent exposure and resisting arrest and was ordered to go through a counseling program, court records said. His law license was suspended for six months.

While neither an admission of guilt nor a declaration of innocence, a no contest plea is treated as a conviction.

Clearly, the BDSM lifestyle leads people to commit murder. BDSM needs to be banned.
