Where I live one of the stores has two of these things out of box on the display toy shelf. Unpacking one of these things is a pain, and not something I see some guy just randomly doing either.

I usually like this site and agree with much of it, but this article is terrible and extremely misinformed. I am firefighter for the department that responded to this call. First of all, He had pellet gun, which is a real gun, not a toy. He took the gun out of the box and was walking around Wal-Mart with it. He was nowhere near the fun section when the police confronted him. The gun he had looks like a Levi t assault rifle, not like a toy. There is an awful lot of assumptions being made here without any information, and I thought that was what conservatives did, not liberals. I'm very disappointed by this shotty reporting.

We'll have to wait for the surveillance videos...

From my understanding, every state is different with laws and regs regarding airsoft guns like these. Some require that the orange tip must remain on the gun. Some states have outlawed these airsoft guns I believe, or certain cities. Just depends where you live.

Yes, Surveillance will clear up a lot of this.

Just FYI, pellet guns and airsoft guns aren't really the same thing.

True, but again, this person that is quoted may not have been there when this happened, for all we know has gotten their information second hand and is wrong. Besides all that, this whole thing was clearly a shoot first, ask questions later. It didn't sound like the kid had a chance to even comply before being shot.

That's the problem. At this point, all we have is hearsay.

I'm as opposed to police misconduct as the next guy, but I want to see proof before I rush to condemnation.

Do you know what a rifle is?

Do you know what sling means? Anywhere that you can legally open carry a rifle it still means that it has to be on a sling on your shoulder. Loading it, pointing it, waving it around don't really count as open carrying.

No not all of them, I just told you they have these things out of box on a display shelf.

Keyword: sold. Plus this guy was hardly in the section where he could be seen as inspecting or demoing the rifle.

So, someone calls the cops about a guy with a gun, cops respond and the guy doesn't immediately drop the gun and gets shot? Should cops ask to inspect criminals weapons before shooting them now? "Sir, can you please allow me to inspect that gun to determine if it is real or a fake looking "real" gun before I act?"

The fact the gun was not real isn't an issue. If it looks real, the cops have to treat it as real. And, someone reported a man pointing a gun at children to 911. What are they supposed to do in that situation?

If the gun wasnt being used to commit any crimes, what exactly did the man do wrong?

Walmart video footage will settle what really happened. Anyone commenting one way or the other before said video is released, may look stupid once it is released.

So you criticize others saying they may be rushing to judgment for lack of information and in the same post determine it is clearly a shoot first and ask questions later situation that the kid had no chance to comply with, even though people there state that he did not drop the weapon when ordered to do so.

Ronald Ritchie, an ex-Marine, said the man was pointing a black rifle at people near the pet section and that “he’s loading it right now.” Later, Ritchie said, “He looked like he was trying to load it, I don’t know.” He then added, “He just pointed it at two children.”

Well that is what they said, but I am hesitant to believe them until I see video of what happened. Because now a days it doesn't take much of anything for them to find a reason to shoot you.

Yes, if you ignore the fact that he appears to have been walking around the store pointing it at people, including children according to the witnesses so far, then yes you're correct.

No it doesn't. I'm not aware of any law regarding the carry of a long gun that requires a sling. You know most rifles and shotguns don't even come with one, right?

Even as much as I hate seeing people open carry in public, most if not all use a sling with their rifles and carry them slung over their back as to ensure no one would think they're carrying it at the ready position.

Don't wave a gun at people - and, when told to drop the gun,.. drop it.

If he'd been white he wouldn't have been shot. Either that or you conservatards would be foaming about how he had the right to open carry and that the police violated his rights. Shoot a black man? Note how there wasn't even a glimmer of the question. You jumped right onto the conservatard "War on Whites" meme, completely missing the difference between the accusations you point at him and the excuses you'd shower a white with.

Without the video, we won't conclusively know what happened, but based on the information we do have (from witnesses etc), it looks like the guy pretty much brought it on himself. If you aim a weapon (it might not be a firearm, but it certainly is a weapon) at others including children (at least according to the witnesses), then fail to follow police orders, bad things are going to happen.

I don't see how the color of his skin has anything at all to do with the story by the way, other than to racists of course.

I was under the impression that they had mandated the dayglo orange barrel tips on toy guns sold retail.

I also don't understand why a sane individual confronted by police wouldn't just put the toy down. But then I don't understand why people litter in their own neighborhoods and I see it every day.
