I was wondering why we don't use biometrics on a nationwide level? Identity theft is a pretty big issue and maybe this could control it a little bit. Are there legal implications?

We do use biometrics on a nationwide level -just not by the federal government for the general public. However, since this is going to turn into a national ID discussion, I'm going to just say voiceprint, retinal scan, and finger&palm scans, baby! :D

the reason I ask is because slashdot had an article about some new Fujitsu technology that uses vein near-IR imaging. What I meant are there any legal implications regarding this on a national level rather than say using your SSN you'd use some biometric identification. I know the ACLU would fight that to the death but do they have any legal ground to defend themselves as to why we shouldn't have it?

Because once your fingerprint, or dna, or retinae scan is stolen, there is no way to replace it. Not like you can cut off and get new fingers.

Hard tokens and smart cards are the way to go.
