I went all out and bought an iPod video and a flash based playforsure compatible player (for working). Subscription based unlimited rentals intriques me, what's the best service with the most full albums? Anyone have personal experience with these services? What's the sound quality like and can you get more obscure indie rock through any of them or do they only have the new Greenday and Creed albums?

Thanks!

I personally prefer allofmp3.com
CHEAP legal mp3s all the way up to lossless codecs you chose on purchase and they charge you accordingly..
most complete CDs can be had for under 2 bucks and they are yours forever to keep and play on ANY DEVICE OR PC! not like napster who locks their crap to 1 device or PC...

Heh, I think that the legality of AllofMP3 is debatable at best

Not to mention when you start getting into high quality codecs you're practically better off buying the CD.

Rental type subscriptions work quite well for me, my Yahoo Music subscription is easily one of the best $50 I've ever spent.

I used to have a subcription to napster. However, I think the file format of the songs is .wma. And, I'm not sure about indie rock selection. I mostly saw big label bands.

I concur, I had napster and their customer support ticked me off. So I went to the less expensive and better Yahoo unlimited.

Ignorance of the law doesn't protect you. It is a simple fact that you aren't in Russia, so Russian Copyright laws are not applicable to you.

I'm reasonably happy with Napster. They don't have everything I want but they do have enough to keep me paying.

I buy CDs that I really like, so if napster saves me from buying one weak CD it pays for itself.

I also like being able to hear CDs I'd never buy, like Shatner's Has Been, or the greatest hits CDs with only 1 new song.

And if you think LE and the Music industry doesnt know about them you are dumb.

It is just as "legal" as napster or Yahoo is.. you pay for the music 1 way or the other.

it is not a warez site or a file sharing service..
it is a paid for service.

Title 17 Chapter 6 Sec. 602 of the U.S. Code covers ?Infringing importation of copies or phonorecords?. You can find this title here

Subsection (a) tells us:

?Importation into the United States, without the authority of the owner of copyright under this title, of copies or phonorecords of a work that have been acquired outside the United States is an infringement of the exclusive right to distribute copies or phonorecords under section 106, actionable under section 501.?

So it's illegal you may think. But take a close look at sub (a)(2):

?This subsection does not apply to importation, for the private use of the importer and not for distribution, by any person with respect to no more than one copy or phonorecord of any one work at any one time, or by any person arriving from outside the United States with respect to copies or phonorecords forming part of such person's personal baggage;?

If MP3?s, OGG?s etc are in fact considered phonorecords, U.S. citizens can legally buy these as long if they are for private use and not for distribution. If MP3s, OGG?s etc. are not considered phonorecords, no import laws apply. The sections of digital audio recording and sound recording have no mention of importation.

So in layman's terms the bottom line of this discussion is:

Downloading from Allofmp3 is legal for U.S. Citizens, as long as the files are for private use and not for distribution.

I've had yahoo's service since last may (I'm using a dell DJ). They have a large selection of music. I don't like their GUI, and the syncing part of the software is a pain. Its worth the $5/mth though. They just need to polish the software.

You are simply 100% inarguably wrong. The reason the RIAA has not sued and/or prosecuted AllofMP3 users is logistical and not legal. You will not find a single judge would interpret that to allow usage of AllofMP3. It is an antiquated subsection, and no doubt the DMCA as well as other laws supercede it. Not only that, but I take issue with the interpretation you provided. I read it as allowing importation of music items that had been properly paid for in another country. Secondly, how are you going to get past the idea of only having one copy? If you burn it to a CD you've instantly violated that statute -- because you are in effect possessing two copies. Even if you "instantly" delete it after buring -- you have still violated the law.

I suggest you understand the full breadth of the DMCA before saying AllOfMP3 is legal.

read what you quoted of my post...i was asking if that was true - i wasn't claiming allofmp3 was legal

here's the allofmp3 link on wikipedia link

have any of you tried emusic? it is similar to allofmp3 in that it offers music in mp3 format with no DRM. it's based in the US, and seems 100% legal. they charge 9.99 a month for 40 songs...anyone have any experience?

But they do operate the service in the US.. just as overseas adult sites must obey US/International laws that govern them so must services like allofmp3 follow laws..
Do you really think a service as mainstream and high profile as them are under the radar for law enforncement? do you really think they are so immune?

http://www.museekster.com/allofmp3faq.htm

http://www.thetechguide.com/reviews/allofmp3/

http://music.tinfoil.net/modules.php?name=News&file=article&sid=1133

there is a nice fat loophole in russian law that allows the distribution of the matieral as long as they pay thier royalties which they have till now...

There is MUCH debate and several ongoing investigations but so far the service is LEGAL until they can close the loophole in the law..
the same law was upheld that says other counties can purchase these good as long as the object or media itself is not illegal in your country..
now the law is thatb MP3s are not an illegal item to HAVE or EXPORT as long as it is purchased and the money is being paid to the copyright holders... which it IS!
now the debate on the law right now is that allofmp3 may not have ALL of the licenses for all fo the music they provide.. that is another issue but so far it has held up in court and investigations..
they are still paying the copyright service that russia MUST pay to do this.. the US disputes the legality becasue there are more than one copyright holder which are not being paid becasue of the laws difference..

As of today dealing with allofmp3 in the US as well as many other mainstream countries is LEGAL.. now should that change thats a whole other ballgame.. but it will also be very public should the law change..

Wow.

*shakes head*

Not only are you dating an escort you think AllofMP3 is legal. Wow.

its legal untill someone proves it isnt, ill keep giveing them my money until someone is sued for dling from them

Ignorance of the law doesn't protect you. It is a simple fact that you aren't in Russia, so Russian Copyright laws are not applicable to you.

And if they are so Illegal as you say they are... they could never operate in the US charging a fee for the service..
And if you think LE and the Music industry doesnt know about them you are dumb.

It is just as "legal" as napster or Yahoo is.. you pay for the music 1 way or the other.

it is not a warez site or a file sharing service..
it is a paid for service.

They don't operate in the US. They operate in Russia and other "blackmarket" areas. The reason why no one is getting used is because of logistics. Absence of enforcement does not mean it is legal.

But they do operate the service in the US.. just as overseas adult sites must obey US/International laws that govern them so must services like allofmp3 follow laws..
Do you really think a service as mainstream and high profile as them are under the radar for law enforncement? do you really think they are so immune?

there is a nice fat loophole in russian law that allows the distribution of the matieral as long as they pay thier royalties which they have till now...

You've yet to be logical. Your point is that "no one has been arrested or sued" so it has to be legal. Again, the reasoning fails because it is one of logistics and not legality. It is NOT legal to import copyrighted works that you didn't pay for. Just because you pay "something" doesn't mean it lets you off the hook. You can't go into Wal-Mart and give them 8 dollars for a CD and then run out. If it costs 14.99+tax they are still going to have you arrested. You are not bound by Russian law -- you are bound by US Law. International Law is not applicable here. I think you need to see what Alito had to say about International Law, and then what the Supreme Court said recently. They do not follow it. It is not a part of our legal system.
