they are about equal when at default clock, but if you put the 9800 to pro levels, it is better, i would get the 9800 np
 
9800. It has better PS1.1 performance, some stencil optimization, and allows for unlimited-length FP shaders. I'm guessing most will recommend Sapphire. I think Sapphire RMA's are handled by the company where you bought it from, so make sure you buy it from a reputable (and nearby, to avoid high shipping costs) store.
