BEST BIRTHDAY EVAR!!!!

Well, today is my 18th birthday and it sure started out well. Last night I went to a high school party, and of course there was drinking and smoking. I drank about 2 fairly large cups of wine (they ran out of everything else) and stopped at around 11:00pm. At around 11:50 the party started to settle down (probably because of the lack of alcohol) and I decided to call my sister to send me home, since I didn't want my drunk friends sending me home. She called me at 11:55 saying that I should go outside because she would be there in a minute. Just as I was standing up to go out the door, the cops came busting in!!! WTF!!! NO!!!! AAHH!!! If they came 5 minutes later, I would've been gone. Some people ran, but my friends and I were cornered in the living room. The cops eventually rounded everyone up and arrested the ones who were over 18 and ran. Everyone got breathalyzer and either walked away free if they didn't drink, called their parents to send them home if they're under 17, got a ticket if they drank and were 18, or got arrested. My friend got arrested because he was so drunk that he falsly informed teh cops of his name. When it was my turn to get tested, I got a 0.04 blood alcohol level, though it doesn't really matter since I'm not 21. The cop decided to write me up as an adult since I was 18 for 11 minutes, though I consumed the alcohol when I was 17. So now I got a ticket and have to go to court. At least my parents don't have to find out, they would if he decided to treat me as 17. What makes it worse is that my court date is during the week that I'm supposed to go to Hawaii with my parents. So I have to either get the date changed or hire a lawyer to represent me. Plus it might go on my permanent record if they don't give me a diversion agreement (I thinkt hat's what its called). I am so screwed :(

Cliff notes:
I drank alcohol at a party the night before my 18th birthday
Cops busted the party, the minute I was about to leave
I got a ticket for drinking because I JUST turned 18 (got ticket 11min past midnight)
Now I have to go to court, which is during the time I'm supposed to go on vacation
I'm so screwed :(
I'm a dumbass

Lesson learned: if you're doing something illegal, leave before the cops come :p

EDIT: Oh yeah, one of my friends got out of it because he barely drank anything and told the cops taht he drank with his parents for passover. He's Jewish only by blood, he's an atheist. And no, he didn't actually drink with his parents.

thanks for the cliffs...

And I thought there'd be at least some mention of getting teh sex in this thread..

BTW, isn't it 21, not 18 ? Why does it matter (what you put in your cliffs) how it was just before you turned 18 ?

21 is the legal drinking age. At 18, you'll get in trouble for drinkingm, I think it's a misdemeanor. Under 18 is when the cops will just release you to your parents.

And damn, I wish I was "getting teh sex."

Cause at 18 you get in trouble as an adult. At 17 you're still a child.

hahahahahaha sucks to be you

The good side to that is that my parents don't have know about the incident. They'd probably disown me if they did.

How many times did they make you take the test before it registered high enough for them to write the ticket?

The majority of us over 21 thinks it's a good law. Who would want to go to a club where there's a bunch of drunk 18 year olds?

You're not screwed. The prosecutor will likely make you do some community service and that's it. Chalk it up to a lesson learned.

OT: What kind of asian are you?

Anyways, I got arrested for something super bad when I was 20 or so, and I was able to settle that through probation + lots of money + community service, so it really depends on what you're being charged for, and also what class felony or misdemeanor.

(If it's a misdemeanor, you're gonna be OK).

And my parents never found out, and they never will, unless someone says something... :frown:

But more importantly, I've already been disowned for not having an asian wife

Edit: Chinese wife

It's more like 2 big plastic cups of "fancy" box wine, lol.

I blew into the breathelyzer once and got a 0.041

I'm screwed because it could possibly go on my permanent record, I might have to pay court/lawyer fees, my parents could find out, and I might not be able to go to Hawaii (my parents already bought tickets, so it would piss them off more since they can't cancel them)

Edit: Chinese wife

I'm Chinese and it's a class C misdemeanor. Your parents seem like they could be more strict than mine. My parents prefer that I date and/or marry a Chinese or at least asian wife, but they will still support me if she's some other race.

Wonder what you can technically do since you were in the act of drinking while 17 but were drunk while 18. Hmmm.

Are you well off? Reason I ask is it doesn't seem like a big deal for you. Most 18 year olds would not even consider hiring a lawyer because he is busy going to Hawaii. They would just tell their parents. You have it all figured out and your solution is expensive. Reminds me of Punk'd episodes where the kid celebrities use money to make the problem go away ("Just tell me how much the car was and I'll buy you a new one! I don't want to deal with this"). Not that there's anything wrong with that, more power to you.

Well, I won't pretend to understand your relationship with your parents, so I can't help you there. If it were me (and I was in a similar situation in college a few years ago), I would just tell them the truth and be honest about what happened. But again, I don't know your situation.

As for your "permanent record", you really shouldn't worry about it. What will likely happen is that there will be community service and a probation period, after which it will removed from your record. Court fees will be minimal, and there's probably no need for a lawyer (what was the citation specifically for? Underage drinking?).

You can request a change of court date. See how that goes before you panic about the Hawaii trip.

Similar thing happened to me, except I didn't drink. Straight edge 4 lyfe :)

Depending on when you were born, you should technically still be 17. I'd argue that. Unless you were born at 12:01am or something.

I am not that well off, my parents COULD pay for it, but most 18 year olds don't have strict Asian parents like I do. Even if I told them, they'd probably make me pay for everything anyway. This is a huge deal for me. The only reason I was considering hiring a lawyer is so that I have someone to represent me if I can't get the court date changed and have to go on my trip. Just because I'm going to Hawaii doesn't mean I'm super rich or anything, this is my first vacation in over 2.5 years and the only reason my parents are taking me is because it's for my graduation.

As I said before, I have strict parents and being honest won't really help, they'll probably punish me just as hard as if they found out some other way and I'd still have to pay everything myself. Also, like I said before, the lawyer is for if I can't get to the court date myself and can't get it changed. The citation was for "minor consumption."

It also sucks that I live in a fairly small college town where the parents are strict and complain about their kids drinking alcohol. Because of this, the police are a lot more stricter. My sister was once at a party at the town next to ours and the cops just let everyone go with a warning even though there were more people drinking and more drunk kids than at the party I attended.
