After visiting Best Buy and American, I've settled on a 40 inch screensize for a TV. However, during the course of the venture I stumbled upon a Sony, Samsung & LG & Toshiba that I really like.

Unfortunately, after examination I noticed that when up close, the text and sometimes the image will jitter. Like small vibrations on the screen. Well, I went to Amazon and searched for all of these tv's and not one of them was satisifed with the "Smart" in the tv. Apparently it's not uncommon to have netflix and certain apps to freeze.

Can someone provide me with a decent 40 inch LED TV with netflix capabilities that doesn't look like poo?

Get a TV for one thing - best picture. Get a receiver/speakers for sound, and a Roku/AppleTV/etc. for apps.

I just picked up this one: http://www.amazon.com/gp/product/B0045TYDX2 for a guest bedroom. My other TVs are Samsungs, but this Vizio was super cheap (free 3d glasses too) and it has all the apps that you want (Hulu Plus, Netflix, Vudu, Amazon Prime) along with built in wifi. So I just mounted it on the wall, plugged it in and it was good to go.

I love my little 32" Vizio XVT. Black levels arent great but its not the full local dimming version. Netflix app works really well as does the wifi. For the price I really like the picture quality.
