What happend to me is terrible.
I went to a shop in the States and bought boxed items as follow:

CPU: AMD Phenom II 940
MB: Gigabyte GA-MA790GP UD4H
RAM: OCZ 2X2 DDR2 800 TITANIUM
GPU: DIAMOND HD 4870 1GB
PSU: OCZTEH 750W QUAD ATX
SATA: SEAGATE BARRACUDA 1TB 7200
SOUND: CREATIVE X-FI XTREMEGAMER
SCREEN :ACER 21.5 WIDE 1920X1080
CREATIVE INSPIRE T6100 5.1
COOLMASTER CM 590 ATX
SAMSUNG 22X DVDRW SATA
DIGITAL MEDIA PRO KEYBOARD

When I came back home (12 hours flight from Boston) 5 days later and start building my rig, the CPU although boxed and sealed with the following OPN: HDZ940XCGIBOX and on the box it was written AMD Phenom II 940 with all its specs was a Phenom 9950!!

Does anyone know if there was a problem with any AMD batch regarding the same?
Actually don't know what to do as sending back the CPU and shipping another would cost a lot.

I would contact AMD directly and let them know a shop is selling reboxed processors. I'm sure they would be interested.

i would return it for sure, thats a huge ripoff. The 9950 sucks in comparison to a PH II.

What do you mean the specs are 9950? Did you already install it? Or are you saying that the specifications on the side of the box matches the 9950's?

Take pic of box and cpu, send to AMD with a copy of your order.

AMD has to be concerned they aren't getting taken for a ride too...lest they find themselves deluged with lots of coincidentally unlucky 940 buyers with all manner of last-gen cpu's shoved in there somehow.

That was kinda my first thought as well.

Every CPU I've ever bought has come in a box with a transparent window so you can see for yourself it's the right model before you open it. You're going to have a hard time convincing anyone that you received the incorrect chip in a sealed retail box.

Fortunately enough, called them and they did not argue at all, after checking my recipt's reference they told me to send it back by courier and they will replace it with no time frame to proceed....
