So there's the deal:

-I have a personal GreenPoint(NorthFork) account for over a year.

-Over the summer I opened a joint account with my GF at the same bank.

-Stupid bank lets her deposite a check with a large amount into the joint account. The check did not fully cleared and within that time the bank lets her take out a certified check for the amount she deposited. A week later the original check bounces and now has a negative balance.

-Another week later, Bank closes the joint account and took all my money I had from my other personal account.

That's just Fked up. I have to take care of her mess and mistakes cuz the bank lets her take out a certified check without any funds in there.

Do they have the right to do this?

seems to me that you fvcked up. Banks let people withdrawl from an account after a deposit. But that withdrawl is on credit and assumes that the cheque is good. If the cheque is bad you owe them that money. And they have every right to forclose on an account per the agreement.

Even if its not my fault and they went into my OWN personal account and took all my money?

joint bonuses, joint penalities. Thats the point of a joint account. Your a$$ is on the line if the other person messes up.

I don't mean to sound harsh but yes. The joint account gives the bank this right.

By signing up for a joint account you agree to let the bank hold you AND your gf responsible in case of situations like this. It's like cosigning on a loan. Sorry, you lose.

Right, but they took money from his PERSONAL account to cover the Joint Account, and unless you signed some kind of waiver I would think that wouldn't be legal.

for future reference... not that i would ever do a joint account personally, but is it advisable then that if a couple is to open up a joint account, would it be best to do it at another institution?

edit: ahh, i see. i guess it has to be something agreed upon when originally creating the joint account.

Every bank I've had never lets me take out anything more than what my available balance is.

Do you still have the agreement you signed when you opened the account? That'll tell you if they're allowed to link accounts to your joint account.

If she went into the bank and deposited a check, she could have said something like this is my paycheck or whatever and the teller might waive the waiting period and make all the funds available.

Fleet allows you to overdraft your account...I took out a few extra bucks and was charged with a $25 fee.

I was kind of mad when I was told of this.

They do this for your benefit. Trust me it can come in handy. I would much rather pay my back $25 for writing a check that I couldn't cover than have that same check bounce. Then I would pay a fee with whoever the check bounced for, plus have to issue them another check, plus it just plain looks bad when you have a check bounce...

Really?...

Every bank I've ever dealt with(only 2... ) will overdraft you account as a "courtesy" if you don't have funds, and then go ahead and charge you an overdraft fee....

I wish they just denied the charge.....

Haha, I hope my bank never does that. I remember one time I was a poor as fvck college student (even poorer then now) and I was running out of gas on a trip down to LA and suddenly hit stop/go traffic above LA with a low tank. If I couldn't afford gas, I couldn't afford a tow truck, now could I? So, I got into a station, shoved in my ATM card and they let me overdraft my account for some gas.
