I'm at the end of my rope with them. I've absolutely had it. And the worst part is, there's nothing I can do about it but bend over and keep taking it.

I had a mortgage that was bought by Countrywide and subsequently bought by Bank of America. I didnt choose BoA. Never once before BoA took over was I even a day late on a payment. 6 years.

Early last year, I noticed that my mortgage payment hadnt been deducted from my bank account. I had auto withdrawal set up. I cqlled BoA and they told me that it had been posted, it was clear from their end, that I should talk to my bank.

I did. Nothing. My bank said nothing had been taken out and they couldnt see anything pending, but that BoA could still pull it at any time. I called BoA back, they said payment had been posted, etc. and that everything was fine.

So, no real answers. I assumed based on what I was told by BoA that the payment would be pulled shortly. I called back the next week, since it hadnt been, and BoA once again told me I was current, the last paytment had been posted, etc. Well, I should have taken the money out of my bank account and sent it to BoA, however I still didnt know if/when that payment would be pulled from my account, and cant afford to pay them double.

This happens the next 2 months. I kept begging them to take their money, but explained to them that if there was a chance they were going to pull it on their own, I couldnt send them a check, so they NEEDED to do the withdrawal.

Next thing I know, I get a foreclosure notice in the mail. Someone finally figured out they hadnt been withdrawing their payments, which I had been trying to tell them for months.

Well now of course they want all the payments, PLUS late fees and lawyer fees. I have no problem making the payments, but late fees and lawyer fees, nope, I cant afford 'em. So they tell us to apply for a modification, etc. Anyway, long story short, we were in foreclosure for a long time. I finally bent over, took a deep breath, made a withdrawal from my 403 (b), and paid them the extra fees just so I wouldnt lose the house. Of course, my credit is so screwed from this, I cant refinance, so I am stuck with BoA. Needless to say, I hate them with a passion after all this. However, we're all current, have been for the last 6 months. No screwups.

Friday - they call me claiming I owe them money. Nope. Not a chance. We're current. Well, no, actually, because they DIDNT TAKE THE FULL AMOUNT of the last phone payment. We had a confirmation number, had the lady's name I talked to written down, etc, but no. They took a measly $60 less than what they were supposed to, than what we agreed upon and I told them very, very clearly, and now I've got another late mark on my credit.

They tried to get a late fee and a $20 phone fee from me, too. I told them no. I absolutely blew my top and told them I wasnt paying one red cent for their screw-up. After screaming at one dickhead and then getting a supervisor on the phone who was willing to actually HEAR what I said, they waived them. I'm at the end of my rope with this BS. I want to make them pay but cant, and I know they do this to THOUSANDS of people.

Wow.

Sounds like they really want your house.

My house was a foreclosure when I originally bought it. It was so cheap it's almost sick. I bought it for about half it's real value. Even at that, it isnt worth a ton of money, there's no reason for them to want it so badly. I dont get it.

same stuff happened to me a few months ago, just short of the foreclosure thing. i also had my couuntrywide mortgage bought by BoA and its been a clusterfuck since then. i now dont have the auto pay set up, i go in and do the transaction manually every month, then make sure to print the confirmation. that confirmation has saved me from their incompetence 4 times in the last year.

Fuck, time to hit the media. That's horrifying.

How do I prove it? If I could prove it I'd have nothing to worry about. It's their word against mine, unless they'd actually release the recordings of the phone calls which obviously they wouldnt.


Never. I like my house, I love my neighborhood. I'll never let someone force me out of my home that I rightfully reside in. We have no issues right NOW, until BoA decides to try to squeeze me for another late fee or service charge for a "mistake" on their end.

haha, like any more bad press is going to affect bank of america... i talked to my realtor last week because we're thinking about moving..... she said " i know a really great lender over at BofA....i said NO CHANCE IN HECK!

i actually have a checking account with them, been meaning to close it.... i've never paid any fees on it though, ever......

Because they were going to SELL MY HOUSE. Without telephone recordings, I had no proof that this was all THEM. I HAD to.

That's insane. Can you send the payment certified mail or something? How incompetent do they need to be to not be able to take your money?

That's an extra 12 bucks a month for their incompetence, but yes, we're going to start exactly that.

Infuriating..... I feel your pain OP. Document everything from now on, record any phone calls (very easy), etc. Can you just switch to them sending you the monthly invoice/bill in the mail?

Sorry for your troubles, I'd be pissed too. I had a Countrywide mortgage too that is now BofA. I don't have auto payments setup though because stupid BofA won't let you autopay unless you have an BofA checking or savings. I guess now I'm glad I don't auto pay!

Yeah, we can. It works better for us if the payments automatically come out on certain days, but yes. We're going paper now, so there's a trail. ONE more phone call or letter that indicates something else is wrong is going to send me off the deep end.

Lawyer up OP. BofA is in a whole heap of shit over this crap right now.

Lawyers cost money. I asked around, but I have to admit I'm fairly ignorant of exactly how the law applies here, and again, PROOF. I WISH I could prove this, on paper. But the fact is, their word against mine, and I'd probably lose. That's what makes me the most angry about this whole thing, they can just keep getting away with it.

Media, Congressman, and contact your DA and see what they recommend. We had problems with BofA but it was business related. I don't understand what they're doing right now but it appears to me they are trying to burn every bridge they can.

There's no branch near me to show up at. When I told them I would defend my house if they tried to take it, with violence if necessary, and that I would LOVE the opportunity to put some of their reps in pain, they definitely didnt appreciate it it. Stupid, I know, but I was so infuriated I was NOT thinking rationally.

Send the payments electronically from your end.
That way there is a tracer on it from the git go.

If BofA claims that they did not get the funds; they can talk to your bank - you will have the verification number when it was sent from your account; The bank can then give BofA the transmittal number through the Fed. The Feds can show BofA that the funds were handed over to BofA under such a tracking number on such a date.
Now it is a BofA internal matter - they can not blame you in any way.

It boggles my mind that someone would choose to do business with BOA. Sorry you were forced into business with them.

Any chance you can refinance with a halfway decent company? Even if you didn't save much money on the interest rate I would see about doing it so you don't have to deal with that level of incompetency again.

honestly this is what the OP should have done to avoid the foreclosure. cancel auto pay after the first few nonauto payments and pay it manually until they fix it.

BOFA still sucks, but the OP could have resolved it within the first two months month like hanoverphist.

If I began having trouble with BoA, I would keep a paper record of all phone calls AND, I would record all calls, including the tones when dialing in to them. In your case, with such records, if I was unsuccessful to the point that you were, I would pay the required fees. I would then opt for a free attorney consultation to determine if I should go the small claims court direction, or if there were damages or something juicy I could nail them for.
