Bad DSL modem or something causing it??

i have a USB 4060 modem, yes i know its the worst kind, but in the mornings, i wake up and i connect to DSL. All if fine until about 9 or 10 am then it disconnects me, modem dies, and it locks my DSL connection so i have to CTRL+ALT+DELETE and end task. Anything that could be causing this? Mostly happns when im gaming or downloading. Can the network actually turn my modem off and on from up there?!?
