Just installed windows XP and my programs on a new hard disc. Can I back up by just copying everything on the drive minus Documents and Settings? Seems to me like this should work, just checking.

no .. windows places a lock on certain files so they cannot just be copied. you'll need to use something like ghost or true image to make an entire backup

OK thanks!
Windows puts a lock on some files even when it isn't running (when the hard drive is accessed from another system)?

Seeing as how "My Documents" as well as your favorites, desktop, and cookies (if you use IE) are stored in Documents and Settings\<your profile name> that is certainly something you would want to back up too ...
