Automobile insurance/fixing question

So I get into an accident - not my fault. Cop comes, no report, but other guy admits his fault,etc to cop and myself. Cop gives me his info says if you have trouble with insurance,etc - call me and I'll help you out.

Guy agrees to pay for damages or have insurance do it.

I get estimates, the guy's insurance company sends out someone to look at damages - they cut me a check. Check amounts for a price somewhere in thd middle of the 3 estimates I got. So kind of an average of the highest and lowest estimate.

However, insurance guy says that he has located a "recycled OEM part" AKA the bumper for the repair. My question: Is this right/legal? Should I demand/ask for a brand new bumper?

Take it to the best repair shop you can find and make them foot the bill. Ask for genuine new replacements. You're in the driver's seat.
 
At least they're getting you an OEM part, a lot of insurance companies will only buy you cheap, poorly fitting replacement parts made by someone else.

So.....what is my actual/legal right? Especially since its not MY company paying for it, but HIS?
 
The legal mumbo-jumbo probably says something about parts "equal to or better than OEM" - but won't say that you can demand OEM replacements. Just use a body-shop that is reputable - and if it costs more, then have their appraiser talk to the body shop. Make sure the body shop is on your side with regards to the type of parts and quality of work you want done.
