attempted rape & Sexual assault

this is actually for a friend of mine who is the victom of the topic. the person was caught already. an update from her has told me that this guy will have no bail and after, will have a parole officer with him.

can someone please tell me what they know about these kinds of situations?
i'm really in need to help this close friend of mine.
how long is the estimated jail time?
what kinda of facility will he be in?
what exactly does the parole officer do when hes with you. what are your freedoms after?

please answer any of the above questions that you can.

why is she so anxious to know the details...is it someone she knew that tried to rape her?

or she afraid for her safety?

As for the OP, there are WAY too many variables to give even general information about what she should expect to happen to the assailant. The sentence and facility will depend on the facts of the case, what specific offense the perp is convicted of, his criminal record and personal background, and whether he pleads guilty or is convicted against his not-guilty plea.

Your friend should really be talking to the victim-witness liaison in whatever office is prosecuting the case. It's their specific job to answer these kinds of questions.

um i dont really know all the details just looking for a little help. state is NYC, NY. girl age 19 guy age 1983 born. has a lawyer court date april24 2005, will the guy be free until then or will he be help in jail/prison for the next month.5? she will be the 2nd girl he tried to rape/sexually assault. he lied at first then after presented evidence confessed.. i dont really know the laws to well so maybe someone that has any exp here with this stuff or any legal knowledge would help.

I know someone who was falsely accused of this, and probably would have been convicted, but the so called victim blabbed she went and said he raped her out of spite when she found out he had been dating another girl. She had some other guy slap her a couple of times and grab her arms and make bruises to make it look good. Since they did have sex, and he admitted it, he was in deep trouble.

He got out on bail, so if this guy has some cash, so will he, and if she has an "extensive" sexual history, she had better prepare for the grilling of her life when she goes to court to testify. Unless the guy hires a really bad lawyer, she will be made out to look really bad, and if she's into anything odd, like bondage or something, it's going to come out, and odds are the guy will walk.

If convicted, he could get between 3 to about 7 years.

Probably depends on the judge. Could set bail real low, the guy could make a deal, or the judge simply give him house arrest so he can get treatment (remember the recent upraro about the rapist pedophile getting minimal jailtime). Sorry but I don't think there is really a way to know. A lawyer may may know more about a judge's track record once the case is scheduled and they know who the judge is.

Again, there are people in the prosecuting attorney's office who are there specifically to help crime victims. She needs to ask them. Your asking here does no good at all for her.

call a lawyer, the DA, or the police station and ask. It's different in every state/county/etc.

The Rape-shield law? I thought that was more to keep the victim's name out of the press, but I could be mistaken.

It is riddled with exceptions in most instances, because it effectively limits the defendant's constitutional right to defend himself in court. In general, a proficient defense attorney will find ways to make a rape victim very uncomfortable in court (this is one of the several reasons it's generally desirable to have a female defense attorney in sexual-assault cases - they tend to have an easier time doing this than men).

Recently in the news was reported that a man convicted of sexual assault was freed from jail after DNA testing showed he wasn't the perp. This man had served 18 YEARS of a 50 YEAR sentence for sexual assault.

I was telling a friend the other day its better to assault and kill than 'just assault since the murder seems to get a lower sentence. BTW, that wrongly imprisoned man can now go to the state (of Texas) and seek as much as $250,000 for false imprisonment. Would you serve prison time for <$14K/year?

I'm glad I don't date around, being in college & all. So many stupid bitches today if you got drunk once with her she'd cry rape, doing something or not. As soon as the woman points a finger, you are screwed. Even if by some luck of the Irish you aren't put on trial, your rep is ruined and your face is plastered across the nation as a rapist.

I don't know what the outcome was, but recently there was a "rape" on campus. A couple stupid freshmen got drunk and the girl cried rape, but the circumstances were hazy and there was question of the girl's accusation. I might look that up....
