ATT Replacement question

Sending my phone (w580i) back for replacement because the keys are cracking. Everything else is fine.
But he told me if there is any physical damage they will charge me for a new phone. It has scratches from where it was dropped. Will I get charged?
I told him it has scratches and he said it's fine as long as it is not cracked.

I hope this is the case.
