the only reference to the probe came from ATI President David Orton, who said the events under scrutiny occurred two and a half years ago and don't affect current business operations
The stock has been under pressure since Monday when the graphics-chip maker said the OSC had concerns about the timing of a fiscal 2000 third-quarter earnings warning and insider-trading activity that took place ahead of the warning.
Revenue was up 34% over last year, to $322 million from $250 million, but that wasn't enough to offset concern over the insider-trading probe or the weak outlook
The insider-trading probe came to light Monday. Some of the trades in question appear to involve ATI Chairman and Chief Executive K.Y. Ho and director James Fleck. Mr. Ho sold 254,000 ATI shares about a month before the May 2000 warning, while Mr. Fleck sold 51,400 shares.
In response to reporters' questions, Chief Financial Officer Terry Nickerson acknowledged that the probe is a distraction, but otherwise stuck to the scripted answer about the OSC probe, which is that the events under scrutiny occurred 2.5 years ago and don't involve current operations
Mr. Orton didn't say when the company's independent review of the OSC's concerns would be completed. Mr. Nickerson said any material information from the review would be made public.
Revenue rose 28.8 percent to $322 million from $250 million, with nearly half that growth driven by new products including the Radeon 9700 chip and integrated chipsets. Sales were well above analysts' average estimate of $264.7 million.
Positive conditions include a delayed launch by rival Nvidia (NasdaqNM:NVDA - News) for its high-end graphics chip, stronger mobile computer sales, seasonally strong PC sales, and Nintendo royalties that "went through the roof," he added.
Analysts said such investigations are always a concern, but noted that ATI's present management is substantially different from the team in 2000
In a statement, president David Orton said, "We were pleased with the strength of our PC business in our first quarter. We obtained key design wins in every product category, and our product strength helped ATI to gain share in all major channels and geographies."
hereShare gains were no doubt helped by the fact that rival Nvidia's (NVDA:Nasdaq - news - commentary - research - analysis) launch of its NV30 chip was delayed, missing the holiday season. In any case, ATI managed to rack up an impressive list of customers for its new Radeon 9700 family of products, including Dell, H-P, Gateway, NEC, E-Machines and Fujitsu

Thank you, Viper. You said it so well!
Another vote to BAN imtim83! But don't do it now; ban him during the month that the GeForceFX debuts so he can't act like a real smart-ass.
Edit: Don't forget that the FTC investigated nVidia earlier this year as well.
