ATI 9.0C issues

I have this card tested in two systems. Keeps crashing in Oblivion and COD demo. DOes not crash in any other game (rest are not DX 9.0c). Forced new COD demo to DX7 and no crashes. Did not enable sound. (Have an Audigy 2 in normal system).

System 1 Asus P5wd-2 M/b I gig PQI mem, 80G Maxtor, Lite on DVD ROM HP CDRW, 550 Coolermaster.
System 2 Gigabyte GA965P-DS3, same memory, 250 G WD, SOny DVD Ram, Antech SIlent Purpower 480.

Plenty of power in both. No OC (yet). Memtest on memory fine. Latest Bios on everything.

Any help? What about flashing to XT to solve issue? This was an open item and I wonder if someone tried to flash it to XT and damage was caused?
 
Day of Defeat Source used to crash on me when I updated to the latest 6.9 CAT drivers, citing some DirectX 9.0 loop error. I updated my DX9 from the April build to the August build and my problems went away.

Not sure if that applies to you, but just thought I'd throw it out there in case it did.
