If this happened here in MI (lots of drinking and then the accident) I think the shooter would just get off with a warning. Last year some parents got blotto'd and passed out while the family dog ate the fingers off their infant, they just got a warning. Drinking can be a great excuse, I guess, so long as you're not driving.
