Association Issue. Advice welcome

Earlier this week I came home from work to find my solar lights all screwed up from my associations snow removal guys. 2 of the lights had the stakes knocked off the bottoms (and said stakes have not been found) and 1 other light had its cap knocked off and then filled with snow which ruined the circuitry. As you can see in the pictures, the lights that were broken at the stakes were thrown back onto the snow pile when they were done.

Since I pay $106 a month in association fees, I was a little ticked at this. The lights were roughly $20 a piece. I called up my association, explained what happened, and asked what they could do to correct the situation. The woman on the phone pretty much told me I was effed. She said that they were not responisble for any damaged property during snow removal. She told me I could email her the pictures if I wanted.

I emailed her the pics and she responded with the same crap about not being responsible for any damaged property.

Now if the broken lights had been set on my porch by the snow plow crew instead of just being thrown back into my lawn, I might have been able to just chalk this up as a loss. With how they threw them back on the snow, and how snotty the woman from the association was with me on the phone...I am still hot from this.

Am I just screwed? Is there I can do? What would you guys do?

I know its not a big $ loss to replace a couple of lights, but people should have some damn decency when property is damaged. grrr

Why are you using steaks to mount lights? You should use stakes or something like that.

A- remove your lights from the yard before snow starts for the season

B- don't live in a house with a HOA

As much as I hate HOA's, IMO, at a minimum, you share the responsibility for not removing the lights before they were buried in snow. Kind of hard for the snow crew to see them if they're under snow, right?

Now if there was only a couple of inches of snow and the lights were fully visible to the crew, that's another issue...and IMO, they're responsible. Good luck collectiong though.

Ehh...I'd buy that excuse, but as you can see in the 1st pic, the lights were pretty clearly visible. Plus, the snow wasn't nearly as high as the 1st pic made it seem. That pic was taken AFTER the piled all of their snow on top of the lights
 
What do your association by-laws say? If they give snow plowing free reign you are screwed. If there is nothing in there about damage to your property while clearing snow..keeping pressing them.

They have free reign according to the snobby bitch on the phone. Hell, they might even be able to come in and rape my girlfriend after they clear the snow and not be liable.


This could have been resolved if:

1. Snow removal team didnt just throw my damaged property back onto my lawn.
2. Bitch on the phone was polite and said she was sorry there was nothing they could do but she would talk to the snow guys and tell them to be more careful


If even 1 of those 2 things happened I wouldnt be nearly as pissed.

Couldn't really tell from the pics how much snow was on the ground. (I know...ALL of it!)
I think you're fucked for collecting from the HOA...time for payback to the snow crew. (get innovative...but don't leave yourself liable for any damages/injuries) 😛

I'd thank my lucky stars that this is the worst trouble I have with your HOA and just buy some new lights and remember to remove them next time it snows.

They could be screwing way worse than this. And no you don't have any recourse.
 
send a letter to the property manager or HoA president detailing the issue. be sure to add that you realize you're SOL in this issue, but would've appreciated some courtesy from the woman you spoke with
