Arrggghhh!!!! Western Digital 40gig refurbed HD died...am I screwed?

I purchased this drive (sealed) from a trader here. He didn't realize it was a refurb when he sold it to me but he knocked some cash off the price and I decided to gamble and keep it. Well...after some very light use for about 4 weeks I moved it to my new system. I fdisked it, scanned it and it was fine at first. I attempted to copy a disk image of my C: drive to it using Disk Image Pro and it hung up while attempting to copy the image. After that the system would not boot because of a drive failure on D: (the WD drive). I can't even scan the drive and finally had to just pull it. I would assume the drive is shot but I thought there might be something else remotely possible like a controller failure on the mobo. I don't have a spare drive to check it but could maybe scrounge one up somewhere if I had to.

I can't remember who I bought the drive from and with Heatware down I have no way of finding out other than posting here and hoping he/she sees the post and responds.

I would appreciate any input.

Have you gone to the W-D website to see if it's RMA'able? It might be a long shot but what the heck?!
 
I'm posting from the perspective of a FS forum trader, but I don't believe the seller is even slightly responsible for the drive. You said they made good on the deal by knocking off a few bucks and you accepted the compensation -- like you said, you gambled and you lost, unfortunately. Four weeks running a drive is a pretty considerable length of time using the product. I could maybe understand if the drive died after a day or two, but this was four weeks.
 
I figured if I couldn't even scan the drive the WD diags would be no good either. I'll give that a shot though.

WD doesn't offer any support for refurbs..unless I read the warranty info wrong.

If I could contact the seller I might be able to get something done with the vendor he got it from...I'm still looking at old emails and PMs..not luck yet.

I'm not suggesting the seller is responsible...I just thought that there is a possibilty that he could help me via his vendor since they sent him the wrong drive to begin with. The only reason I even posted that part is to avoid the inevitable "why did you buy a refurb", "that's what you get for buying a refurb", "don't buy refurb" posts 🙂

This is a long shot I know but I'm not gonna just chuck $80 in the trash without at least trying to figure out an alternative.

Gotcha. I'm skeptical the vendor could help either (there was probably some kind of 30 day return period on the drive) but you never know. Everything I would've done without fear of making it worse has already been suggested. 🙁 Good luck with the drive, though. But look on the bright side: you at least have a pretty decent paperweight or doorstop. 😉

edit: you would probably have a better chance of the seller seeing this thread if you post to FS with a "if you sold a HD to moocat, PM me" but that's just me.

Even if it's not my drive, I need to respond.. Am I on drugs or something..? How can that be a "pretty considerable length of time"..? You would think that he'd get, at the very least, a 30-day (4 week) warranty on a refurbished item.. OF COURSE, if the guy told him specifically, "SOLD AS IS, FUNCTIONAL OR NOT, NO WARRANTY" then and only then would I understand.. However, it's my understanding that unless it's said, there should usually be a grace of 30 days/4 weeks/1 month..

But who's responsible for providing the warranty? The seller? The retailer that sold to the seller? The manufacturer? And under what terms did the sale take place? As I understand consumer law (and I don't know much so lawyers, please chime in) warranties and implied warranties are transferred only to the original buyer. And there is *probably* an implied warranty from the individual seller but since you or I don't know the complete details, you or I aren't the final authority.

Now if we're talking about users selling to other users to help out, that's a different matter. The seller can be cool about it and make a refund or partial refund but again, they aren't held to anything other than their word and if they care about it, their reputation.
 
The person who sold the drive to me is not responsible. I've been using the drive for less than a month but I'm sure I've had it in my possesion longer than that.

I'm going to try the WD diags to see if that comes back with any info. One thing I failed to mention is that when I took the drive out it was unusually warm. 7200rpm drives tend to be hotter but even taking that into consideration the drive was hot.
