I recently purchased a 2-year old custom-built home. Since this is not a tract-built home, I expected the quality to be much better than it is; however, I've found that the builder (Village Bldrs) has some serious quality control issues and the home has some blatant design problems. I have realized this after living in the home for a couple of months, and needless to say, I am disappointed, at best.

My most recent problem is A/C related. The home has 2 A/C units -- a small unit for the master suite and a much larger unit for the rest of the home. The home is one-story, 2800sf. Very soon after moving in, we noticed that the A/C in the master suite never quit running. I would wake up in the morning with frost on the windows (not literally, but damn cold). I quickly realized that the thermostat and the air return for the unit which cools the master suite is NOT located in the master suite. The thermostat and air return are located in the hallway about six feet from the door to the master suite! This means that the thermostat, which is intended to control the temperature in the master, is actually only sensing the air in the hallway and the rest of the house. This is why the A/C NEVER stops running!

I called an A/C repairman out today and he confirmed what I already knew -- ABSURDLY STUPID design flaw. He actually laughed when he looked at it and commented about how home builders never cease to amaze him. I feel much the same way. Anyway, he recommended that the thermostat and air return be relocated INSIDE the master suite where they should have been all along. He gave me an estimate for $750.

I'm wondering if I would have any recourse with the builder? Is this something that I could force them to pay? It is certainly their fault.
 
I am certain they have a clause in the contract that says AS IS, but even if they don't they will certainly say that it is not broken and give you some crappy reason for it being like that.
