Are return policies universal?

Encountered this situation with Newegg.com.....Returning a defective WD 40 gig HDD.....Return policy is 15% restocking fee on return for refund..Replacement option is a new or REFURBISHED HDD......I didnt buy a Refurbished one,so I shouldn't have to be sent a refurbished one.The restocking fee sux,I can see it if I just change my mind,but its defective,its not my fault....This is my first mail order purchase in quite a while,buddy recommended them,so I didnt check around..The order was nicley packed,and delivered on time,but two components(HDD,and Floppy have already failed).Both were O.E.M.,hopefully thats not where the problem is..........:)

Don't know the law over in the US but here if the goods are DOA (dead on arrival) and you have notified the supplier in reasonable time you should be entitled to get an exact replacement (not a refurb) free of charge.
