Are hate-inciting web sites illegal?

I forget where the law stands on this. Obviously we all have freedom of speech. But aren't certain web sites that incite hate (KKK sites, etc.) illegal and can be shut down? Anyone have details on this?

No, freedom of speech. Unless you can prove the website presents a clear and present danger (which you can't) , the website wont be shut down.

its not illegal

greater scrutiny is placed if the site is like an advertising, or has a political meaning behind it

I think it depends on the content. If they're saying "KILL ALL NON-WHITE STRAIGHT PEOPLE", then it's probably against the law as they're inciting people to commit murder.

So are warez sites, but that doesn't mean they're going to go away...

The internet is pretty lawless. Just make sure your servers are somewhere good like sealand

And even if you can, you can still stay up if the ACLU is behind you.

Nope, unless you can prove a direct causal relationship between the website and someone killing someone else, you can't shut down the site
