Applying for a role in a company that I'm currently working with as a third-party consultant.

I've not seen anything in my contract pointing this out as a potential issue, but the long and short is that a role popped up (completely unsolicited and offered, just through a job listing) at a company that I am currently working for through my current company. The role is a great fit for my skill set, but I am unsure of any possible legal or moral (lol) implications for applying and potentially landing the role. Some helpful information:

  • I live in Texas -- this may or may not matter
  • I've been with my current company for over a year
  • I have been working with this customer for 8-9 months
  • They are not a competitor
  • The role is in the parent organization of one of the groups I've done a lot of work with
Outside of the potential awkwardness of my resume coming across someone who knows me's desk and there being a potentially awkward conversation, I wanted to see if anyone was aware of possible issues for applying for this role.

Helpful answers only please -- don't be fucking stupid. Hugs and kisses.

You're in Texas and you're asking for the moral implications of changing jobs?

Isn't Texas an "At-will" labor state?

If it is, there's your answer, provided you've got nothing in your current contract with your current employer preventing doing what you ask.

Only ask that particular question because the company currently employing you sure as heck can drop you like yesterday's dirty diaper, no questions asked.

Could potentially fall under conflict of interest even if not a competitor. I would maybe talk with your manager first to see what they think. If your company has a contact for that you can use that too. Mine has a form you can fill out and it's (supposedly) anonymous. It's best to ask this sort of stuff anonymously if you can, but if you have a manager you trust that's another option.

You need to find out what the agreement is between your employer and the company you are currently placed at. I bet the place you are at can’t make you an offer.

This.

More than likely the contract between companies prevents solicitation, even voluntary.

Wait until the contract ends and then look into it

I checked on glassdoor and the average comp for that role within said company is ass (shocking, frankly). I ain't going anywhere for less than a 30% bump.
