Once again, Apple demonstrates that the rules are only applicable to their competitors and not themselves.

I didn't even realize anyone owned that design. I've seen it used so often that I've always thought it to be a common design.

The article linked by Kenmitch says they created it in 1944. If it's a trademark of the company it's still likely to be protected, but any design patent they hold would have expired since then. Of course it's possible that the laws in Switzerland are different or that some other form of protection exists.

Like I said, it will be interesting to see what comes out of this.

If anything, they'll change the clock design for Swiss phones. I really don't think much will come of this.

I think I read somewhere that they were in talks with the people who own the design. So probably gonna be like something like them using the term iPhone and not licensing from Cisco and then ending up paying some undisclosed sum.

It's a trademark, not a patent and if you had looked at the images you would see that they don't even use the numbers 1-12 on the clock face. I'm not a trademark lawyer in the US or Switzerland, but my understanding is that a trademark is anything used to identify a company, service, etc.

Click the link that Kenmitch posted (2nd post in the thread). It's pretty obvious that Apple copied the exact design of the SBB Railways clock, which has been an identifying trademark of the company for almost 70 years.
