Apartment Woes

I just got a bill dated 8/13/2007 from an apartment I resided at over the summer. My lease begun 5/26/2007 and ended 8/11/07.

They said I lived in a different apartment and that my lease expired on 7/31/2007. So they are trying to charge me an extra $87.50 of rent.

They billed me for four cleaning charges totaling $130 and another charge of gross market rent totaling $212.50. The $212.50 and $87.50 add up perfectly to the $300 deposit. Does that seem a little sketchy?

The four cleaning charges were bogus too.
1. Bathroom needs cleaning $25. I figured I would get this one even though I cleaned it well. I think I got screwed over because my other roommates left all their toiletries. I was sure to mark in how disgusting the bathroom was before I moved in.
2. Carpet Cleaning in the Living Room $45. The carpet was very dirty and was like that since the time I moved in. I made sure to mark this in the move in inventory form as well.
3. Kitchen floor needs cleaning $35. Basically the same story as above.
4. Touch up paint needed in bedroom $25. My room had two large holes which had been covered with putty but not painted over. I marked these in my move in inventory form and made sure that I didn't make any holes or cracks my self.

Did I mention they claimed I lived in Room A when my room was actually Room D? It sounds like I'm getting charged for someone else's problems.

Also, do they have to show receipts for any "cleaning" or "repairs" they did? If they don't show receipts can I refuse to pay?

Basically the story is: I move into a shitty apartment that was not cleaned at all before I moved in. I moved out leaving it in better condition, but they still charge me for bogus cleaning fees.

Do you guys have any advice? I can take the hit of $130, but I'd rather fight back for the sake of not letting an apartment company screw me over.

Happened to me before. Unfortuantely, i did not take pics, so I lost my deposit. Bastards.

You should have set up some catered BBQ....... and charged everyone $10 to attend.

It wouldnt have cost you anything silly! All you do is invite coworkers and friends and make them pay you $10 to come! Great idea isnt it?

Well the first problem you got to get yourself out of is the proverbial "he said, he said" game. Because the burden of proof that your landlord is lying is on you, not him, in most states should you decide to attempt to runt this to small claims court.

Bottom line is yes you are getting taken to the cleaners. Your only way out is gonna be with fighting back with evidence (not words, opinions, etc). Do you have proof (photos, signed documents, etc) that you moved into a dirty apartment?

If you don't then you need to stop saying that immediately because the landlord will use the fact that you are saying things without proof to further undermine anyone's perception (such as a judge) that you are not exagerating your other claims without evidence as well.

Are you getting the picture? You need proof, otherwise it is your word against their's and they know the system far better than you (that is where they got their balls to pull this shit on tenants).

Good luck, I've been down your road before. Learned the hard way. Even to this day I still do a walk-thru of a new house I rented this summer with video recorder in hand and documented the entire house - all walls, ceilings, floors, interior and exterior - because this is what happens all the time.

I should have taken pictures and video cameras, but I was in such a hurry to move in. I guess I'll probably learn with a $130 mistake. Do I still have a case about the lease date and room? I definitely have a signed contract stating when my lease ended. Will the move in inventory sheet hold up at all?

Also, what happens if I just don't pay it? Can they charge me interest and make me owe them a large amount of money a couple years down the road? Take me to small claims? (Is it even worth $130 for them?)

Feel lucky. Mine was a $1000 mistake. Also, don't just not pay it. Is $130 worth headaches to you? isn't this your deposit? if so, how will you get it back?

They mysteriously added $300 in unpaid rent charges to balance out the $300 deposit I paid.

Well, they could do the work themselves and bill you for it... so even if they have to give you a receipt they could still screw you.

Well I go there unannounced and ask for receipts it's going to be hard to fabricate them on the spot.

Now that my lease has expired and I'm in debt to them. Am I legally able to pay them in cash? I'm going to the bank later today to withdraw $130 in pennies.

Go into their office and dispute it. Ask for receipts and show them the inventory sheet that you indicated the conditions prior to move in.

I leased an apartment once that was filthy when I moved in it. I got it cleaned up and lived in it for the duration of the lease. When I left, I got hit with a lot of bogus charges too. I even cleaned the carpets when I left an got charged for 'water stains' on carpet. That was because the carpets were still damp from the steam cleaning I did.

I tried to fight it, but the management/owner company are pros on this. I had before and after pictures and complete documentation because I heard they play these games. I sued in small claims court, but they got numerous continuations (by mail) until about a year and a half later, I had to drop it when I moved out of town.

I'm going to call them after class today and just ask them some general questions and try to get some charges removed. I won't mention receipts so if I do end up going to the office, they can't fabricate them ahead of time. They'll probably claim they lost the inventory sheet or that I wasn't descriptive enough.

Mail them a registered letter and state that the charges were for Room A, but you resided in Room D.

IIRC from apt hell, I made the manager sign the moveOUT checklist to ensure that no bogus post-moveout charges are incurred.

The move in sheet should hold up, provided someone from their office went through with you in an inspection and signed the form too. I had two different apartments while living in Texas and this was what those two different lease companies did.

I'd fight it.

Get a video if you pay them in pennies ... they can't deny that, it's legal tender. Hahaha
