Apartment fudged up lease contract, I want out, how to do it?

So I'm living at my first apartment by my university.
The lease was supposed to be a year, but they screwed up on the contract. It says lease begins 9/1/2008 and lease ends 9/30/2008.

Should I give a month's notice that I'm leaving? I'm sure they're going to try to argue with me to get me to stay, but legally, there's nothing they can do right?

Ideally I want to move out before the next rent payment on Feb 1st, but I'm guessing I'm probably going to have to wait till end of next month at the earliest?

im a noob at this stuf.. PLZ HALP!

You need to read the lease and see what the move out requirements are and follow those.

My lease has a 60 day move out requirement. If they screwed up on my lease like yours they could still go after me for trying to leave prior to the 60 days.

Also look at the 'month to month' rate. They could try and claim you were month to month and were not paying the premium and try to stick you for that. Every lease I have signed has clearly said something along the lines of "At the end of the lease you may renew the lease or pay a month to month rate of $XXX" and that XXX is usually $20-50 more than the rate you are paying.

Be VERY careful before you walk in their and go 'hahaha you screwed up, I'm leaving' or else you might be the one getting screwed.

If the lease has expired based on the 9/30/2008, you're currently month to month. It may vary by state but you need to give 30 days notice.

I've been paying the same rates as I have on my lease.
The contract says 30 days, and I don't see a month to month rate.

So I should be set to move out end of februrary?

Ah I just read your post more carefully. Makes a lot more sense now.

I don't know what they can do legally but it makes sense to give them 1 month notice. Also, it's too close to Feb. 1 now so yea you're probably looking at at least one more payment. Hope it works out.

A 1 year lease would start on 9/1 and end on 8/31 of the following year.

I found a place that's a fraction of the rent.. $400 vs $720. I wouldn't go through all the trouble of moving out just to point out someone's mistake.
