Apartment complex requesting 60 days move out notice?

I live in New Jersey and my complex just sent a letter to me saying I have to notify them within 60 days (which is a week from now) if I plan on moving out of my apartment. If I don't respond they will automatically renew for the next year.

Is this normal? Legal? 60 days seems like an awfully long time they need in advance. We've been considering moving... but how the hell do I know if I will find something in 2 months. I feel like a month is more appropriate.

What does your lease say? 30 days is the norm.

I am pretty sure that in Ontario, 60 days is required for the landlord to force you out. That is to say, it's entirely reasonable to ask if you're planning on leaving.

If you leave on your own, you also need to provide 60 days.

That's the norm around here!

Edit: the question on legality I would have is if you don't reply they automatically renew - is that written in your lease? If it was in mine, I'd have not signed it. I assume by renew that means a new 12 month lease. In Ontario, the norm is to go month to month after a 1 year lease, but it varies depending on a bunch of factors.

I've heard of 60 days before. You can just give them a heads up saying you are potentially leaving.

My last couple of leases was 60 days, and they provided the new lease agreement a couple weeks before that 60 days, so I basically immediately knew if I was going to move due to a ridiculous rent increase.

In my area, you need to start looking for places 60-90 days in advance if you want a nice place.

I dunno, since nobody else has mentioned it yet, have you considered reading the lease to see what it says? Just throwing it out there.

Im going to venture that since they are asking you for 60 days, they are actually demanding it of you because..... wait for it...

Learned this life lesson in my first apartment. I was able to negotiate a cheaper early termination fee. Be nice and ask. Mine was about 25% of the 2 month total. Had already put down deposit on new place so it save me a good bit of change. Other option is just move and let them try to collect. They may put it on your credit. My GF did the same thing twice and ther apartments never even tried to collect. Depends on how big the apt complex is and how much you owe.

Well, given that the landlord is giving you written notice of the terms of either

A) vacating the premises or
B) renewing your lease

and

C) most leases and state L&T laws will have a clause that state that the landlord must give written notice of a certain amount of time in amending or modifying a lease or
D) allow the tenant to opt out and vacate the premises

I'm pretty sure that all bases are covered here and nothing illegal is going on (note, this may vary from jurisdiction to jurisdiction - check your local laws). If you don't like the terms set forth by the landlord, the action to take is pretty damn obvious.

And yes, I've seen leases with 90 and 120 day notice clauses in them.

Most places require advance notice. My last apartment required 60 days written notice prior to moving out, and the notice date starts on the next 1st of the month.

It generally takes 2 months to fix and then fill an empty apartment and they don't want to be out that rent because you decide to just leave them hanging.

Yeah I understand why its done... just 2 months... who knows what could happen. I figured it was legit, just annoying. Kind of like how we are expected to give 2 weeks notice to companies that have no problem giving you 0 days notice.

2 weeks notice is really just a courtesy.
