Apartment complex "lost" my rent check

I always pay my rent on (sometimes before) the 1st. They have a grace period 'till the 4th. I left my check in an envelope with a fill in for our regular office manager on 6/1. Just last night I got a notice of late payment and impending eviction if not paid.

I'm sure they will accept a new check for the ammount (no late payment), but should I be concerned or make them pay for a "stop payment" on the lost check?

yeah call your bank to see if the check has been cashed or not yet...thatll tell you for sure... if not, make the apartment ppl pay for the stop payment on the check

yep check with your bank first.

i would bring it up. depends on how much you trust them, and the people that work there.

i would bring it up. depends on how much you trust them, and the people that work there.



Well basically lay it out. Say "I have proof the check was written and sent out (provided you do) and you guys can either get your act together and try to find it...or pay for a stop payment and Ill cut you a new one.....if they dont understand why you dont want to write another one without stopping the first one they are just stupid

Had the same problem. Dropped it in the payment slot just like always. Except mine went "missing." It wasn't worth the hassle of bitching to the staff. I just cut the office a new check and notified the bank of the other check. Problem solved.

What really pissed me off is when I received that offical court looking document for a failure to pay. Especially since I've paid on time for the last year. All they had to do is call me and I would have stopped by. Hell I live right across from the office!!!

Stop's are only good for 6months, so if they find it in 6months and 3 days then cash it the stop won't do you any good. Just write the number down and watch out for it and tell them that if they find it they are to return it to you.

They threatened you with eviction for being late a few days? wow how often are you late?


Just go put a stop payment on it and cut them another check.

I know people who work in aparment leasing. They have things called "5 day" notices. Basically if you dont pay your rent on time, they go and drop off one of those on your door that says you have 5 days to pay up or they will begin the eviction process. Eviction isn't all that easy though, they can't just knock on your door and say get out. They have to go through lawyer and jump through a bunch of hoops. They are basically just trying to scare you into paying.

That said, anytime you drop off rent, ALWAYS ask them for a reciept. That way you can prove that you paid on time and they got your money. Only takes a few seconds and its worth the piece of mind.

That's probably the most annoying part. Since our apt. has a 5 day grace period, I see 95% of the renters drop their rent off at 4:29 on the 5th of any given month. I'm always on time (on the 1st, not the 5th) and usually a day early and the mgr. notices. Why couldn't she just pick up the phone and call? It's not that big of a complex, I'm not a mean person at all, and I'd be happy to help. No.. I get a nice notice (non official) with a big "ARE YOU MOVING???" and "If you can't pay rent, I suggest you move out to avoid eviction on your rental history, blah, blah, blah"

Update - I did finally talk to the mgr. She said the 'fill-in' put it in the wrong place and she'll look for it when she gets into the office.
