Anyone know the laws on prebilling backordered merchandise?

I'd heard that it's illegal for internet/mail order companies to prebill merchandise that's backordered and they can only charge once the item ships. A few merchants I've talked to agree, but I can't seem to find it in writing anywhere. Is that a real law of just a myth?
