1) Buy similar shirt from same store.
2) Go back next day w/receipt, tell them they didn't take the security tag off. Wait about two weeks, return second shirt that you bought.
3) ??
4) Profit

The above advice is only valid if in fact you purchased the shirt in question. If you didn't, you're SOL. ;)

true, i was wondering about that. perhaps there were two tags, and the guy removed one? long ago, I can't recall...

try using a small enough zip tie to insert into that hole on the side. i think there is a mechanism inside that releases the pin when something is inserted into the hole there. it may be magnetic, so a zip tie may not work.

One time that happened to me. You can just pry them apart by using something to level the two components apart. Screwdriver, whatever.

i'm gonna try the hammer tomorrow. i've heard that there's ink inside that'll stain the cloth if the lock is broken though. but what the hell, i can't wear it anyway :D

Well, you could always resell afterwards :p

Have you tried calling the store you bought it from? Perhaps if you explained what happened they would call the store local to you and have them remove it. Well, good luck with the hammer :)

Maybe get a hacksaw blade....slip it carefully in between the fabric and the plastic tag so that it rests on the metal post holding the back onto the tag...then very carefully saw through the post? It might be sort of tedious, but it's not very thick and shouldn't take too long. If you pull that tag or use a hammer, ink will come out and ruin it.
