Possession of weed is a mistermeaner offense here, and i dont think federal crimes have mistermeaner offenses.. (i think.. feel free to correct me)

And in November, Tax Cannibus 2010 will probably get passed seeing how it will feed california billions of dollars, so if your a pot head, your best becoming a Californian...

It's (typically) a misdemeanor in NH as well, but the specific classification of the state crime is not relevant to any applicable federal laws. Different issues entirely.

Well...first off...I'm not the friend in the story, the persons that's in this story (both of them) are in Lubbock, TX...I'm in Atlanta...read the post. Actually, my friends name is Grant Tipton...don't care to hide it, hes royally pissed me off...his dad is also the Vice President of Plains Capital Bank in Lubbock too...Perry Tipton, be sure to call and harass him LOL!

And second, I'm not a stoner...well, not anymore...so miss used/spelled words or sayings be damned, people fuck up as do you STFU or GTFO...you know how that goes.

That said, I have to agree with a lot of people here. His truck wasn't searched and if it was he would not have been allowed to leave. I searched this myself and it is true...so right there the whole story starts to crumble.

The the warrant...I know Lubbock...police are not going to get a warrant on something like this...one because the judge will laugh that cop out, and two cops themselves cant even get warrants, it has to be detectives or DEA/FBI people...and I highly doubt that someone dropping a bag of weed (that was under the arrest limit) would go all the way up in the ranks until it hit the ceiling for a warrant.

Side note- detectives are cops too.

No, but an overzealous store clerk and some video evidence of what could be construed as a drug deal going down is.

IMO even that in itself is not enough to just up and get a warrant then cruise over the following day and search someones home.

If you do not consent to vehicle search and they don't see anything from the outside, the dogs would have to sniff something to get probable cause. That's the reason why they car was still there - dogs didn't pick up anything.

sorry to break it to you, but cops lie to get to what they want. if they want to search the car, they will regardless of the reasons why you think they shouldn't because they can intrepret actions to justify their search

this is coming from friends that are leo from local pd of many ranks to us marshalls. most of the time they don't give a shit, but if the cop has nothing better to do and is bored, then they can have probably cause very easy. hell even if you act a bit nervous, probable cause if the cops has a hard-on to search your vehicle.

funnt story dogs at prison always hit my cars for having gun powder or ammo in them (ammo is against the law to have in ur car i guess at prison parking lot heheh) retarded sounds like there was alot missing from the story and if he had more in the car why look in the trash for a small amount just move on and dsy say it was pretendo or something..
