Anyone familiar with car accident laws? Particularly in NC?

If you are, could you PM me and give few advice? Thanks.

Here is the cliff-note.

-An employee leaves work after his shift at night.
-The employee gets into a car accident on his way home from work. (Rainy night)
-He claims that the company should pay and cover the cost. His claim is that since he was on his way home from work, this is work related accident.
-Obcourse the employer disagrees.

Btw, The employee does have an insurance. But I guess he just want employer to cover as much as possible.

I live in NC and can say for the most part UNLESS he was doing soemthing for the company or on the "clock" the company has nothing to worry about.

BUT if he was asked to drop off a deposit, or pick up xyz for said company then they may be held liable, but even then he would have to show the company put him at harm, not the weather and/or his driving.

And I also think they should fire his stupid ass for trying to pull this bullsh!t. Fvcking people trying to get over on everything. :roll:

good luck with that! I ma going to demand that my company pay for my gas and oil changes tommorrow. I'm sure it will go over well.
 
He was going home, so he wasn't on the clock. No way his company is libel. I'll go out on a limb and say this covers all 50 states.

Yeah, I think it's pretty safe to say that regardless of state or country, the company could not be sued for libel in this case. 🙂
