1. Simple Assault

2. Aggrevated Assault

I'm not a lawyer, but I did stay at a Holiday Inn Express last night.

guy goes to girls house, scares girl, she calls her guy friends. Guys try to save the day for the girl, and get screwed.

people just need to wait for the cops. its less macho, but at least u wont be in trouble. its never worth taking it into your own hands.

there were about 5 witnesses vouching that the other guy who got beatdown started the whole altercation, would that have any effect in the case ?

if it get prosecuted then not really other then prosecutor job will be much easier in getting conviction but because its his first offcen and its not felony he will be released on probation and will pay mostlikely most fine

i was told by a former police officer of 15 years. When i say record, it will be in computer that they talked to you thats all

you mean like speeding. It will be in police computer that you got a speeding ticket and will say it got dismissed but don't affect you in any other way

Not sure about N.J. ,but a first time offense of assault here(S.C.) would probably get you nothing more than a year on probation and a fine.

Also,if he would like to have the offense wiped from his record(don't have to check that box anymore on applications:)) he may qualify for Pre-Trial Intervention.You only get one shot at it though(on your first offense) ,so if he does it,make sure he completes it,or he'll be right back in court on the same charges.
