Any laws regarding parking over your curb? -- I made an enemy next door.

So my parents got to move in last December into a rather ghetto neighborhood. We used to live in the safest neighborhood in the city.

Our street has a somewhat narrow road and its hard to turn into the driveway, even with the government measured curbs; that is, if people are willing to follow the curb.

This old nissan maxima parked over the curb, and I left a note stating that we would have their car towed if they parked like that again. I saw the guy come out of his house (next door) and took the note, folded it, and put it on our family car. I was pissed because he ignored the note. So I opened the door and told him not to park like that again because its hard enough for us to get into the driveway already. But he starts yelling at me. He said "IM NOT BLOCKING YOUR DRIVEWAY, SO WHAT IF IM OVER THE CURB? IM NOT BLOCKING THE DRIVEWAY"

I tried to explain to him that the curb was there for a reason. He kept yelling back at me. Since I have such a short temper, I yelled back at him and he drove off. I'm so pissed right now. I wanna beat him up, but he's a cranky 50 year old Chinese man, while I'm just an 18 year old college student.

There's been a LOT of people parking like that ever since we moved here. My parents can't even use the driveway anymore because of peoples' parking habits. We leave notes but people ignore them. If we call to get them towed, my parents are scared that people would retaliate by damaging us or our home.

Is there anything we can do about this? I would really like my parents to be able to park the car inside the garage. I live in San Francisco.

If you are new to the neighborhood, you could have asked nicely the first time.
 
His car is already pretty messed up. It'd be a waste of my time.

And I don't think his body could take a hit.

Actually, I did. He's a very stubborn man.

Edit: He was talking on his cell phone while my mom was trying to talk to him about the curb. He said "let me finish my call then I'll move it." My sister was waiting for at least 10 mins so she could get out. Disrespectful if you ask me.
 
What do you mean "over the curb"?

Do you mean that he had pulled up over the curb and onto the grass?

We don't have grass for a good 2 miles here.

Not over the curb, just past what he's technically allowed to park.

I'm still not following. There is no "my curb" if you are parking on a city street. On a public street, all spots are open game. The only time you can't park in a certain spot is under certain city/neighborhood rules or in front of water hydrants.

I think he's talking about the driveway entrance...the curb ends at the driveway, so "parking over your curb" means parking past the curb into the driveway entrance.

Ahh gotcha. Guess I'm not used to that sort of thing around here. I think I've had to parallel park twice in the last 5 years 😱
 
So basically his car is hanging out into the street?

I'm sure that's illegal..

My parents can take care of the chinese cussing for me. 😉

Well I'd get his car towed but I dont think the tow truck would get there fast enough unless he decided to park like that overnight. And besides, he's our nextdoor neighbor. He may be a punk, but once I tow his car they won't be very neighborly anymore.

I just need to know how to make sure this doesn't become a problem for my parents in the future.
I've asked some friends and they said I could get the city to paint part of our curb red, but I'm not sure if people would see it, let alone follow the lines.
 
You're in SF?
Take pictures, Call Dept of Parking Enforcement during weekdays. If he's illegally parked, they'll ticket him. Get enough of those they'll boot it, or hold up registration.
If you can't pull into driveway/ garage, it's not legally parked.
P.S. If it's in the driveway, TOW IT! It's rough in the big city, you gotta establish domain or they'll just walk all over you.

If you want to get the curb painted red you call the Department of Parking & Traffic. From your description it sounds like he is parking in the wing of your driveway? The part where the curb slopes down to the lip, right?

If that's true, you can have him ticketed or towed. If he is jsut parking close to it and not actually there, then it is perfectly legal and there is nothing you can do.

You want to be absolutely sure that you are right in this case though. In SF, people are very territorial due to the lack of space. I once knew a person who had a car ticketed because it was in his driveway, and the guy who got ticketed did everything to fight it. He even went to the Building Department to make sure the cut was the right size. He caused the property owner a major headache...

If you want to know anything else message me, I actually worked for a City Bureau...

 
buy a beater and park it in that spot

better yet, park it in his front lawn then set it on fire....that will teach him
