Update 22 posts below.

Desperation has sunk in. We went to court against a concrete contractor who did some poor work at our house in Yuba City, CA. The Judge suspended the case and directed us to bring in a contractor to speak to the work in the pictures we provided. Court is tomorrow and the contractor called today to say his wife was having surgery and now he couldn't come. I am sure the judge will slam us for not bringing the contractor in as he directed. So far I have been unsuccessful in finding anyone. Anyone know any contractors in the area? :(

Motion for continuance? I don't know but your lawyer should ask for that or something like that.

Small claims so no lawyers. The judge initiated the first continuance, he may not give a second but it can't hurt to ask.

The Judge said he didn't know enough about concrete and wanted us to bring someone to fill him in on what the pictures were showing. I'll upload a couple and post them.

You guys didn't have any freak weather events did you? Like extreme cold or extreme hot streak the day after he poured?

No freaky weather. It was overcast and about 50 degrees. This was poured 1 year ago this month. It has taken this long to try and resolve it. There is color in it that was supposed to match out tan carpet. It dried a lot lighter than that picture shows.

Hmmmm....if it was overcast and 50 degrees, you can't ask for much better pouring conditions.

What you need is a statement from a physician verifying the surgery. The judge should accept that.

If I wasn't stuck in a hotel room, I'd call my pops. He just received his 25 year pin for being in the Bricklayers & Allied Craftsman Union. He's poured concrete for 25 years now.

We had a statement from an out of town contractor. The judge wanted to speak to him or another contractor in person. The guy who wrote the letter is the one who's wife is having surgery tomorrow and now can't make it.

Absolutely PERFECT for pouring concrete!

Does the contractor who did the work keep saying it's a good job, or is he saying there are extenuating circumstances?

He says it's good. He left concrete on my house and sliding glass doors, the finish is poor.
I am on the phone with the Contractors State License Board, he may not be licensed for concrete. he has a C27 Landscaping
I think he needs a C 8 concrete.
I am out the door. Thanks, all.

Well, we lucked out. The judge was more sympathetic than I gave him credit for. He continued the case because our contractor couldn't show because of his wife's surgery today. He did make the statement "if it's true that his wife is having surgery today" and when I answered that I had contact information for him to verify this, he cut me off with a shake of his hand and said "ya, ya, whatever". This guy is a piece of work and one of a few people to ever intimidate me.

Maybe that's why he's the judge...

HERE COME 'A JUDGE, HERE COME 'A JUDGE!

BTW: Congrats! How long of a continuance did he grant?

UPDATE

I was just doing some research to see what it would take to subpoena the Local 400 Cement Finishers Union to obtain contact info for
the sub that my contractor hired. While doing this, I received a call from the "sub" who informed me that he was not a sub and was in fact an employee of the contractor. He also told me that he doesn't have a contractors license. If the judge will take my word on that, I believe that the contractors counter suit will be thrown out as neither one of then were licensed to do the work. At this point I will only need to show "damages" and those will hopefully be deducted from the contract amount.
Morale of the story (so far): Don't just look to see if a contractor is licensed, make sure he has the correct license for the scope of the work.
:)
