antitrust laws in US are jokes.

this is what happen:
if you charge too much, you are a monopoly
if you charge too low, this is unfair competition
if you charge the same price, this is price-fixing/collusion

the rest is up to the lawyers to determine if you are guilty or not.

Same with the economy. Prices too high, its a sign of inflation. Prices too low, its a sign of recession.
 
I'd say that antitrust enforcement is a joke now. The Bell companies were broken up in the 80s for being a monopoly and now they've all re-conglomerated.

Charging too much by itself doesn't create a monopoly. The term only applies if you are the only provider of a good or service.
