You can play the same game. Between spamd, various blackhole lists, white list processes and whatnot, you can be virtually spam free too.

But what stops ISPs or individuals that run their own mailserver from doing these things? Most don't even think about it. And some customers will bitch and moan about one little email their friend sent from a known spamming host that didn't get through instead of thanking the admin for the 300 spam messages that didn't.
 
I wonder if they could come out with a national 'do not spam list' like the one for telemarketers. Hand out hugh fines to anyone who sends spam to the registered e-mail address
