Ok, so I have two new sticks of Patriot 3200XBL ram that fails memtest at almost every one of their specified speeds/timings. It also has a rating of 2-2-2-5 but SPDs to 2-3-2-5. It seems to run ok at that setting

Should I/do I have a right to RMA it? Or should I live with it?
 
AFAIK, if it's rated for 2-2-2-5 it should pass Memtest etc. If it doesn't, seems to me you s/b able to RMA it. Also seems to me if it's rated for 2-2-2-5 it should "SPD" at those timings too.

The only exception I can think of is some ram shows a rating of X-X-X-X, but when you read the fine print it will say somnething along the lines "above timings for an Intel-based systems only, for AMD timings are x.5-x-x-x"
 
they set the SPD higher because some motherboards don't like those settings. It is is in fact rated for those settings it should run at them though.

You paid to get those timings, and it doesn't work at those timings. RMA it.
