The guy was pissed off and I'm sure he had something to say about it. I'd be pissed to if my son just got beat down in the streets cause some thugs felt like it. He was 100% within his rights to say something. Him confronting those low lifes did not give them justification to beat him to death. It's murder. It's pathetic I even have to explain this to a grown ass man.

Yes, you'd be right that the old man had every justification to do so.

But common sense, he did not have.

He is #1) Old, #2) Unarmed, #3) Outnumbered

The fact is, if the situation was different (he had a buddy, and they were fit guys or whatever), and they ended up beating the two thugs to death, they would still be "justified" in some sort of defense of other/temporary insanity case.

Its a shame, but the guy should have called the cops. Never put yourself in danger. What he did was stupid and it cost him his life. If your not in danger and you can get to a phone, call the police. You don't go and confront assailants. My guess is they'll get 15 and be out in 10.

Someone assaults your son, you call the police.

You know, that whole choice thing you are championing works both ways. The two dudes choose to escalate also. Now you tell me using common sense, should two young adult males feel threatened enough to provoke violence from an older man and a guy they just laid out? No, I don't think so. Instead, they chose to assault him, and now they have to live with that choice. If the assailants felt that threatened, which I highly doubt, they could have just walked away.

It's not like they beat him down, put the boots to him and continued beating him until he died. They beat the guy up, he fell and hit his head.

Yes, the battery was intentional...the death doesn't appear to have been intentional.

Do they deserve to go to prison for a L-O-N-G time? Hell yes.

Unfortunately, with Kahleeforneeya's current prison overcrowding and budget problems...they'll get out in a few years tops.

Unless you're going up against someone Fight Club style, there is no such thing as "Mutual Participants". Confronting someone and being assaulted back is two separate things, retard.

Try that shit with someone and assuming they live, you will not only go to jail but you'll get your shirt sued off your back. Plead "mutual participants", and the Judge may just send you back to prison for being a waste of free oxygen.

Again, the law and the justice system treats crimes differently depending on whether the participants had a choice to be involved in the confrontation or not, whether they had an opportunity to safely avoid it or not.

The difference between a victim and mutual participant pretty much boils down to whether or not one had the option - at any time - to walk away safely or to avoid the confrontation, or they escalated/contributed to it.

The Asian men were the victims of an assault and battery. That crime was completed - finished. They were not injured, the perpetrators were blocks away. Instead of calling the police, the father and son mentally donned their Superman costumes, and went after the perpetrators who were already blocks away, either causing a second confrontation that wasn't necessary, or continuing/escalating the earlier confrontation by their own free choice, whichever you prefer. They lost.

You don't have to like it, you just have to pull your head out of the Asian mens' ass.
