That is when you have a friend make a fake call to the old employer and ask for a reference. If he says anything bad you get to sue again for slander.

Hahaha! I don't know about slander, but if there is ever a time in the future where I need a reference and I hesitate putting an employer down I will have a friend do this for me just so i know what to expect.
