After looking at pic2 again your kids are going to kill you, if you have any, when winter comes up and you sell that part of land. I know my kids would kill me if I did that. Man when winter shows up your gonna be father of the century because you bought one hell of a small ski/sled slope with the new house you built for them.

I bet anything if you sell that land to him he comes out yells at your kids to get off it ;)

I'm going to assume the neighbor was NOT trying to be an ass. It really does look like he's being an ass since he put the shed in the ONE little part of the lawn that is not his property. But looking at his property, that's where I would have put the shed too if I owned the land. In the back corner. So he may have just been assuming since he talked with you about buying the property that it wouldn't be a problem, and he didn't want to have to move the shed after it was put up. He may not have known that the shed would cause a problem with the title.

I would assume all of that is true, recognize that the guy is going to be your neighbor for years, and handle it accordingly. Ask him to move the shed until you own the property and then sell him the land at a fair price. But think about what a fair price really is. Realistically that corner of the lot is wortheless to you compared to the rest of the lot. It's worth more to him than it is to you, so let him make you an offer.

Well the builder did tell me that the guy did have a survey done of the lot a few weeks ago. So I'm thinking he may have been told that he can't just purchase / divide off a small piece of a lot. Builder did say that he's asked the neighbor to move the shed and the neighbor said he would. So the neighbor did know the property boundaries and probably figured that if he can't get it cheap he'll just take it.

When I questioned the builder about why the shed was put up he either wouldn't or couldn't give me an answer. In fact when he first put up the shed the builder wanted me to wait till after closing to talk to the guy about moving the shed or buying the land. When I started talking property law / titling it was like a light bulb went off in his head and he said "Ohh that's right you can't obtain title with an encroachment". So either the builder is not the smartest guy (which I doubt since he is also a real estate agent) or he's not telling me the whole story.

Why would the builder be in on it? :confused: The OP is the builder's customer, he's spending hundreds of thousands of dollars on a house. Who do you think the builder cares more about? It sounds like the builder just doesn't feel like dealing with it.

Talked to the developer and he said that we could cross hatch the lots and sell off / divide them however we want. He even said that the surveyor in his office could do it as a favor to us. We'd then just have to pay his office's attorney about $200 to do the paperwork.

Now the question is how much should that land be sold for. Ideally I think I'd like to sell off the entire left hillside since I know his kids will probably be playing on it and I don't want any problems if they fall etc. Flat land around here is selling for around $4 to $7 a square foot ($47000 for .2 - .25 acres). Developer also said that since you want to be neighborly etc I could sell him the sliver of land for $4000 to $5000, which is again about the price the builder was talking about. However, I'm still betting this guy figures he should get the land for free / dirt cheap.

Don't sell crap. Builder needs to get it straight.

No, I definitely wouldn't sell him the whole hillside - as it is, your backyard view is your own to do with as you wish instead of staring into his backyard. If you sell the hill you're subject to whatever he does with it. Just sell off that little corner at the top. That's what, about 900 ft^2?

I don't think it's usefult to take the price of a full lot and divide by the size of the lot to get a $$/ft^2 number. The assumption there is that the lot will be useful for something to the general market like building a house on and have road access etc. This little sliver is only valuable to you and the neighbor and isn't good for more then a small shed. On the other hand, you hold the cards if he really wants the land...

to be honest even if he had not acted like an ass i still wouldnt sale th eland. you never know what you may do with it in the future.

Why not be decent and go talk to the guy. Ask him why he put the shed there, obviously in your property. Make him stand up to you in person. If he can't do that, then tell him to have it gone and politely tell him you hope there are no more mistakes made in the future. If he says he did it on purpose, well then, you know exactly where you stand with him and how to treat him. Having someone you dont like live next to you isnt the end of the world, and it actually looks like there's plenty of space to where you won't constantly be in each other's faces. What you could do is build a fence one foot from the edge of you land, and paint the side facing your neighbor a wicked neon pink... o_O

Excavate to ground level right up to the property line and build a retaining wall. You gain more useable space and the neighbor gets a cliff he can fall off of. :)
