good ol g.w.bush want's to limit judgements in liability suits against doctors to 250,000 bucks.

There does need to be a cap, but that is way too low IMHO. Doctors are human just like evryone else. Mistakes are made even with all the double checking that is done. It sucks, but it is inevitable. :(

I read that the 250K cap was for punitive damages only, so medical damages would not be limited. Also I believe you can classify pain & suffering under compensatory damages as well (don't quote me on that) so that would not be affected. Nevertheless I think a cap would usurp the jury's function which plays the major role in the American justice system

EDIT: read the article, I was wrong - he wants to cap pain & suffering as well - not right IMO.

Guys, like we discussed in the other thread, the cap is on "punitive" damages, not compensatory. In her case I am sure she would get millions for pain and suffering, medical bills, etc. The cap does not change that. It simply puts a cap at 250,000 for damages intended to punish the doctor. Or maybe you guys would like it better if we didn't have doctors because the cost of insurance premiums are more than the doctor even makes in total income. You might think that is an exaggeration, but in some states doctors are already paying more than 50% of their income just for insurance.....
